| | | | | | | | Purpose:
This is a request for the City Council to adopt a Resolution to approve an intergovernmental agreement with Maricopa County, implementing a cooperative agreement to waive traffic control permit fees in certain circumstances. |
| | | | | | | | Background/Summary:
The City of Peoria adjoins Maricopa County at various locations. As a result, it is not unusual for the City or its contractor to be constructing a project adjacent to or near the County’s right-of-way that requires traffic control devices to be set up in the County’s right-of-way for property notice and safety reasons. In such instances, the City must apply for and pay for a traffic control permit. The same is true when the County or its contractor is constructing a project adjacent to or near the City’s right-of-way.
City and County staff agree that paying one another for these fees is unnecessary and that the process of obtaining such permits should be expedited to the extent possible. Under the terms of the proposed intergovernmental agreement, the City and County will waive traffic control permit fees for one another and expedite the review of traffic control applications and plans. Once approved, the agreement will remain in effect through June 30, 2021.
Below are the terms of the proposed intergovernmental agreement:
Responsibilities of the County and the City:
- Each party shall ensure that each permit issued under authority of this agreement complies with all standard permitting requirements and other terms as may be deemed necessary by the County Transportation Director (or designee) and the City Manager (or designee)
- Each party shall ensure any contractor liability insurance is acquired and lists the permitting party as additional insured. Each party shall also provide a copy of the insurance certificate to the permitting party, as applicable.
- Each party shall reference this agreement when applying for a permit under the conditions of this agreement.
- Each party shall submit the required traffic control application(s) and traffic control plan(s).
- Each party shall expedite the review of the traffic control application and plan, if applicable.
Responsibilities of the County:
- The County Transportation Director (or designee) may, in coordination with the County Manager (or designee), determine projects suitable for eligibility to waive traffic control permit fees.
- Upon receipt of proper documentation, the City shall waive all traffic control permit fees for County projects meeting the criteria in the agreement.
- The City Manager (or designee) shall retain appropriate files related to any permit issued under the authority of this agreement until all terms provided in the agreement and the pertinent permit have been satisfied, or as otherwise required by law.
Responsibilities of the City:
- The City Manager (or designee) may, in coordination with the County Transportation Director (or designee), determine projects suitable for eligibility to waive traffic control permit fees.
- Upon receipt of proper documentation, the County shall waive all traffic control permit fees for City projects meeting the criteria in the agreement.
- The County Transportation Director (or designee) shall retain appropriate files related to any permit issued under the authority of this agreement until all terms provided in the agreement and the pertinent permit have been satisfied, or as otherwise required by law.

B: Deny approval of the intergovernmental agreement with Maricopa County. This will preserve the status quo, which requires the City and the County to pay one another for traffic control permits that benefit both parties. |

| | | | | | | | Fiscal Analysis:
This agreement is cost neutral. If approved, the City will no longer collect traffic control permit fees from the County for certain projects, but neither will the City pay these same fees to the County. The City’s fee for a traffic control permit is $100, so the magnitude of these fees is quite small. |
