Background/Summary:
During the development process the property owner at the southwest corner of Pinnacle Peak Road and Lake Pleasant Parkway dedicated right-of-way to accommodate the future roadway improvements for Pinnacle Peak Road. The ultimate improvements have been put on hold but current development activities have prompted the need for infrastructure and the realignment of Pinnacle Peak Road through the intersection to improve the safety of the traveling public.
Although no new right-of-way was needed from the parcel at the southwest corner of Pinnacle Peak Road and Lake Pleasant Parkway for the improvements to Pinnacle Peak Road from 99th Avenue to 102nd Avenue, the project team coordinated efforts with Circle K during the design phase to address any concerns regarding construction activities and provide a seamless transition between Circle K’s existing driveway and the new roadway improvements. During one of the discussions, Circle K requested that the City consider allowing them to relocate their existing monument sign into the right-of-way to allow greater visibility to the motorists. Development and Engineering staff worked with the design consultant to ensure that landscaping didn’t prohibit the relocation nor did it restrict visibility to the existing location of the sign.
The City will maintain its prior rights of the land. Circle K will bear all costs associated with the use of the land (ie relocation of and maintenance of the sign). The license will remain in effect for as long as Circle K leases the adjacent parcel or until such time as the City demonstrates a need for the right-of-way.
