Intergovernmental Agreement Amendments, Arizona Department of Transportation, 75th Avenue and Cactus Road Intersection Improvements and 75th Avenue and Peoria Avenue Intersection Improvements 

Purpose:

This is a request for City Council to adopt two separate Resolutions to amend the existing Intergovernmental Agreements (IGAs) for the 75th Avenue and Cactus Road Intersection and the 75th Avenue and Peoria Avenue Intersection with the Arizona Department of Transportation (ADOT) to increase the federal funding for both projects and to include the construction of a new City Waterline for each intersection.
Background/Summary:

In April 2011, the City applied to the Arizona Department of Transportation (ADOT) for federal funding assistance through Highway Safety Improvements Program (HSIP) for the two subject intersection projects, as each intersection ranks in the top five for high crash locations in the City, and subsequently, on November 8, 2011, both applications were approved by the Federal Highway Administration (FHWA).

 

In April 2013, City Council approved IGAs for 75th Avenue and Cactus Road and 75th Avenue and Peoria Avenue.  The agreements outlined that ADOT would manage both safety projects through all phases of design and construction.  The city would participate and coordinate with ADOT and pay their local match and for items not eligible for HSIP funding. 

 

In June 2016, City Council approved the first amendment to the aforementioned IGAs for both Peoria Avenue and Cactus Road.  This increased the federal funding for increased design costs.

 

The City has now amended the IGAs for ADOT to construct new waterlines for the City of Peoria with city funding as part of the larger construction projects to reduce impacts to the community and to coordinate the waterline with the larger reconstruction of the intersections.

 

The City was also able to secure $1,576,500 in additional federal funding from Maricopa Association of Governments (MAG) to use for these projects, which will reduce the City contributions to the projects considerably.  The City's matching funds are programmed in the existing capital improvement program.  A portion of the programmed funding for these projects will not be needed as a result of this amendment.

Previous Actions:

  • In April 2011, the City applied for HSIP funding for safety improvements at these two intersections.
  • Received notification letter from the FHWA on November 8, 2011, confirming that the safety improvements were approved as eligible to use HSIP funds.
  • In April 2013, City Council approved IGAs with ADOT to administer the projects.
  • In June 2016, City Council approved amendment 1 to IGAs for additional federal funds for design.
Options:

A:     Approve the adoption of the resolutions approving amendments to the IGAs for the intersections of 75th Avenue and Cactus Road and 75th Avenue and Peoria Avenue with ADOT and pay $2,255,708 to install waterlines in both intersection improvements for the aforementioned projects.

 

B:  Deny the adoption of the resolutions approving the amendments to IGAs with ADOT and have a City contractor install the waterline prior to the intersection projects, extending the construction time for the intersections.  Additionally, not applying the federal funding to the project would require the use of City funding that has previously been allocated for the project.

 

Staff Recommendation:

Discussion and possible action to: (a) adopt RES. 2017-32 approving Amendment No. Two to the Intergovernmental Agreement with the Arizona Department of Transportation for the intersection improvements of 75th Avenue and Cactus Road; and (b) adopt RES. 2017-33 approving Amendment No. Two to Intergovernmental Agreement with the Arizona Department of Transportation for the intersection improvements of 75th Avenue and Peoria Avenue, to increase the federal funding for both projects and to include the construction of a new City waterline for each intersection.
Fiscal Analysis:

The total estimated City cost for the construction of the waterlines is $2,255,708.  Funding for the waterlines is available in the FY2017 capital improvement program in the following projects:

  • Water Line Assessment and Replacements - UT00335 ($1,068,682)
  • 75th Ave Waterline, Cactus and Peoria - UT00143 ($1,187,026)

 

The additional federal funding to these intersection projects will supplant City funds currently budgeted for the projects.  These funds will be able to be reprogrammed toward other projects.

 

The estimated total cost of the 75th Avenue and Cactus Road Intersection project is $9,518,280, split between federal funds ($6,596,497) and City funds ($2,921,783).  The City previously paid $475,731 for design and utility relocations.

 

The estimated total cost of the 75th Avenue and Peoria Avenue Intersection project is $8,940,771, split between federal funds ($6,576,206) and City funds ($2,364,565).  The City previously paid $867,001 to ADOT for design and utility relocations.

Narrative:

The City is in the process of acquiring all necessary rights-of-way for the projects.  Once ROW is obtained the work will commence.  ADOT anticipates intersection construction in Summer 2017 by ADOT's contractor.  This work will continue through Fall of 2018.
