Right-of-Way License for Business Sign, 75th Avenue and Cactus Road 

Purpose:

This is a request for City Council to discuss the adoption of a Resolution authorizing the execution of a Right-of-Way License to allow Ninth West Properties, L.C. to keep their existing business sign in its current location south of the southeast corner of 75th Avenue and Cactus Road.

Background/Summary:

While the 75th Avenue and Cactus Road intersection improvements were being designed one of the business signs within the parcel owned by Ninth West Properties was identified as being within the proposed new right of way on the east side of 75th Avenue south of Cactus Road.  Due to the topography and potential impacts to the remaining parcel the City proposed that the sign be allowed to remain at its current location even though it would be encroaching upon City right of way once the acquisition of the land necessary to construct the intersection improvements was purchased.

 

Development and Engineering staff approached the property owner regarding the sign and received their concurrence to enter into a Right-of-Way License to allow their sign to remain in its current location.

Previous Actions:

Development and Engineering Department staff worked with the 75th Avenue and Cactus Road Intersection project team throughout the design process to minimize impacts to the surrounding properties while maximizing the safety benefits of the proposed intersection improvements.  The Development and Engineering Department along with the Planning and Community Development Department staff are in favor of granting this Right-of-Way License to Ninth West Properties, L.C.

Options:

A.     Approve the adoption of the Resolution authorizing the execution of the Right of Way License to allow the existing business sign to remain in its current location within the new City right-of-way.

 

B.     Deny adoption of the Resolution resulting in the relocation of the business sign as part of the 75th Avenue and Cactus Road intersection safety improvement project.

Staff Recommendation:

Discussion and possible action to adopt RES. 2017-31 authorizing the execution of the Right-of-Way License to allow Ninth West Properties, L.C. to keep their existing business sign in its current location south of the southeast corner of 75th Avenue and Cactus Road.
Fiscal Analysis:

There is no fiscal impact to the City associated with granting this Right-of-Way License.

Narrative:

Recordation of this License will provide a public record of the terms allowing the business sign to remain in its current location.
