This is a request for City Council to adopt an Ordinance renumbering current Chapter 15 (Municipal Court) to Chapter 5 and amending various sections of the Peoria City code.

As discussed at the January 24, 2017 Council Study Session, City staff began a comprehensive review of the City Code in July 2016.  A comprehensive review of the City Code has not been completed for many years. As a result of the review, staff is recommending that the arrangement of the code chapters be changed to reflect a systemic order.   Staff is recommending that the current City Code Chapter 15 (Municipal Court) become Chapter 5 (Municipal Court). Chapter 15 will be replaced by a new chapter focused on Police issues at a later council meeting.  

Highlights of the topics amended in the new Chapter 5 (Municipal Court) include:

• Juries fees and mileage per diem
•  Municipal Court may include any applicable additional surcharge, enhancement fee or increased amount to any assessments.
• Remove the section regarding the Judicial Selection Advisory Board.  This section will be placed in the New City Code Chapter 3 (Boards and Commissions) which will be presented to Council at a later council meeting.
• An increase to 30 days from 20 days following service of a citation, a notice of prior violations may be filed.  And courts may consider such prior violations as a basis to increase the sanction for the pending citation.
