Revision to Amendment No. 1, Intergovernmental Agreement, Maricopa County Flood Control District, City of Surprise, City of Peoria, and Maricopa County, 115th Avenue and Union Hills Drive Drainage Improvement Project 

Purpose:

This is a request for Council to approve a revision to Amendment No. 1 of the Intergovernmental Agreement (IGA) between the Flood Control District of Maricopa County (District), City of Surprise (Surprise), City of Peoria (Peoria), and Maricopa County (County) for rights-of-way acquisition, utility relocations, construction, construction management, and operation and maintenance of the 115th Avenue and Union Hills Drive Drainage Improvement project.
Background/Summary:

On January 10, 2017 the Council adopted Amendment No. 1 of the Intergovernmental Agreement (IGA), LCON07814A, which revised the language regarding Peoria's invoicing and reimbursement to accommodate funding in FY18-21.  The amendment also revised the agreement between partners to construct both phases under one contract.  Upon review of Peoria's amendment, the City of Surprise decided to revise the language regarding their invoicing and reimbursement to match that of Peoria's.  The revision to Amendment No. 1 does not affect any of the language regarding Peoria.

 

The purpose of the revision to Amendment No. 1 is to:

 

  • Revise the City of Surprise's invoicing and reimbursement language to match that of the City of Peoria.

 

The revision to Amendment No. 1 of the Intergovernmental Agreement has been reviewed and approved as to form, by the City Attorney's Office. 

Previous Actions:

July 3, 2012 - Council approved an IGA, LCON04312, with the District and Surprise for the design of the project.

 

December 9, 2014 - Council approved an IGA, LCON07814, for completion of rights-of-way acquisition, utility relocations, construction, and construction management, as well as assuring which agency will be responsible for its share of on-going maintenance and operation.

 

January 10, 2017 - Council adopted Amendment No. 1 of the Intergovernmental Agreement (IGA), LCON07814A, which revised the language regarding Peoria's invoicing and reimbursement to accommodate funding in FY18-21.

Options:

A:  Approve the revision to Amendment No. 1 of the IGA with the District, Surprise, and County to partner and cost share in the rights-of-way acquisition, utility relocations, construction, construction management, and operation and maintenance for the regionally beneficial project.

 

B:  Deny approval of the revision to Amendment No. 1 of the IGA with the District, Surprise, and County and risk favorable consideration by the District in future drainage improvement projects, studies, floodplain determinations and other program assistant sponsored by the District. 

Staff Recommendation:

Discussion and possible action to approve the revision to Amendment No. 1 between the District, Surprise, Peoria and County for the rights-of-way acquisition, utility relocations, construction, construction management, and operation and maintenance of the project.
Fiscal Analysis:

Funding for this project is scheduled for FY 2021 in the adopted 10-year capital improvement program. Staff is requesting a reallocation of this funding through the upcoming budget process to align with the invoicing schedule in this proposed IGA.
Narrative:

Upon approval of the revision to Amendment No. 1 by all agencies, the project team consisting of representatives from the City of Peoria, City of Surprise, MCDOT and FCDMC, will commence the construction of the project.
