SUBJECT:
Abandonment of City Interest, Federal Patent Easement, 70th Avenue and Mariposa Grande Lane 

Purpose:

This is a request for City Council to authorize the abandonment of City interest in a portion of a Federal Patent Easement (Easement) for Roadway and Public Utilities as recorded in Docket 2635 Page 74 located east of 70th Avenue, south of Mariposa Grande Lane.

Background/Summary:

This request comes from Christian and Larisa Feher who own the parcel east of the southeast corner of 70th Avenue and Mariposa Grande Lane. Their parcel identified as Assessor Parcel Number 201-13-303 is currently encumbered by a 33-foot wide Easement for roadway and utilities along the eastern boundary.  The property owners have requested the abandonment of the portion of the Easement within their parcel to allow greater development potential.

Previous Actions:

Staff reviewed this request and has determined that the Easement that runs along the eastern boundary of the parcel is no longer necessary for roadway and utility purposes.  Letters from the existing utility companies giving their consent to the abandonment have also been received by staff.

Options:

A: City Council authorizes the abandonment, removing the Easement encumbrance from the property.

 

B: City Council denies the abandonment maintaining the current Easement encumbrance on the property.

Staff Recommendation:

Discussion and possible action to adopt RES. 2017-34 declaring an emergency to abandon City interest in a portion of a Federal Patent Easement as recorded in Maricopa County Recorder Docket Number 2635 Page 74.
Fiscal Analysis:

There is no fiscal impact to the City associated with this abandonment request.
Narrative:

The abandonment will release the Easement encumbrance from the property and allow more flexibility for future development.
