SUBJECT:
Initial Zoning, 83rd Avenue and Pinnacle Peak Road 

Purpose:

This is a City-Initiated request for City Council to adopt an Ordinance providing initial City of Peoria Zoning for approximately 7.22 acres of recently annexed property located at the northwest corner of 83rd Avenue and Pinnacle Peak Road from the Maricopa County Rural 43 (RU-43) zoning district to the City of Peoria Suburban Ranch 43 (SR-43) zoning district.    The City has not received any support or opposition to this case.  Initial Zoning must be provided according to state statutory requirements.  On March 16, 2017, the Planning and Zoning Commission unanimously recommended approval of this case.  
Background/Summary:

On June 17, 2014, the Mayor and City Council adopted Ordinance #2014-22, thereby annexing the property that is the subject of this initial zoning request.

 

The property has been developed as a City retention basin and is intended to remain in that use without further development on the site.

Previous Actions:

A public hearing was completed for this item at the March 16, 2017 Planning & Zoning Commission Meeting. The Planning & Zoning Commission recommended approval of this request, with a 5-0 vote.
Options:

A:  Approve as recommended by Planning & Zoning Commission; or

B:  Deny; or

C:  Continue action to a date certain or indefinitely; or

D:  Remand to the Planning & Zoning Commission for  further consideration

Staff Recommendation:

Discussion and possible action to adopt ORD. 2017-18, approving a change in zoning for approximately 7.22 acres located at the northwest corner of 83rd Avenue and Pinnacle Peak Road from Maricopa County Rural 43 (RU-43) to City of Peoria Suburban Ranch 43 (SR-43).

Fiscal Analysis:

This request is not expected to result in a direct fiscal impact to the City.
Narrative:

If the City Council takes action to approve this case, it would bring the City into compliance with state statutes regarding the provision of zoning to annexed properties.
