SUBJECT:
Initial Zoning, New River, Rose Garden Lane and Rose Avenue Alignments 

Purpose:

This is a City-Initiated request for City Council to adopt an Ordinance providing initial City of Peoria Zoning for 2.1 acres of recently annexed property located west of the southwest corner of the New River and Rose Garden Lane and Ross Avenue alignments from the Glendale A-1 and Single Family R1-6 Districts to the City of Peoria General Agricultural (AG) and Single Family Residential R1-6 Zoning Districts. The City has not received any support or opposition to this case. Initial Zoning must be provided according to state statutory requirements. On March 16, 2017, the Planning and Zoning Commission unanimously recommended approval of this case.
Background/Summary:

The subject property was part of an annexation/de-annexation that was coordinated with the City of Glendale to redefine a portion of the boundary between the two jurisdictions along the New River. On September 2, 2015 the Mayor and City Council adopted Ordinance #2015-13A thereby requesting the Maricopa Board of Supervisors hear the request for annexation of the property that is the subject of this initial zoning request. At their November 4, 2015 hearing, the Maricopa Board of Supervisors affirmed the request to de-annex the property in question from the City of Glendale and to annex it into the City of Peoria. The parcels are located within the New River Wash and are generally adjacent to other properties located within the wash corridor. The New River Wash and New River Trail pass through the two parcels. Annexation of the property has allowed for improvements to the New River Trail. No additional development is expected to occur on these parcels. Pursuant to A.R.S. §9-471.L and Section 14-39-9 of the Peoria Zoning Ordinance, the City must assign City zoning to the annexed property.
Previous Actions:

A public hearing was completed for this item at the March 16, 2017 Planning & Zoning Commission Meeting. The Planning & Zoning Commission recommended approval of this request, with a 5-0 vote.
Options:

A:    Approve as recommended by Planning & Zoning Commission; or

B:    Deny; or

C:    Continue action to a date certain or indefinitely; or

D:    Remand to the Planning & Zoning Commission for further consideration.

Staff Recommendation:

Discussion and possible action to adopt ORD. 2017-17, approving a change in zoning for approximately 2.1 acres, generally located west of the southwest corner of the New River and Rose Garden Lane and Ross Avenue alignments from the Glendale A-1 and Single Family R1-6 Districts to the City of Peoria General Agricultural (AG) and Single Family Residential R1-6 Zoning Districts.

Fiscal Analysis:

This request is not expected to result in a direct fiscal impact to the City.
Narrative:

If the City Council takes action to approve this case, it would bring the City into compliance with state statutes regarding the conferring of zoning to annexed properties.
