Intergovernmental Agreement, City of Glendale, New River North Shared Pathway Improvements; Williams Road to Pinnacle Peak Road 

Purpose:

This is a request for City Council to adopt a Resolution to enter into an Intergovernmental Agreement to identify and define the responsibilities of Glendale and Peoria for the local cost share, design, right-of-way acquisition, construction, construction management, and operation and maintenance of the New River North Shared Use Pathway Improvements.

Background/Summary:

In 2013, the City of Glendale applied for and received federal funding to extend the New River North Shared Pathway from Williams Road to Pinnacle Peak Road. According to the Maricopa Association of Governments (MAG) Transportation Improvement Program (TIP) estimated federal and local funding costs are:

 

Design Cost                             $110,000.00

Local Design funding               $110,000.00

 

Estimated construction cost     $512,381.17

Federal construction funding    $330,850.00

Local construction funding        $181,531.17

 

Total local costs                        $291,531.17

Glendale funding                       $204,071.82

Peoria funding                           $  87,459.35

 

On May 13, 2014, the City of Glendale entered into an intergovernmental agreement with the Arizona Department of Transportation (ADOT), for the New River North Shared Use Pathway project.

 

On June 28, 2016, the City of Glendale and ADOT entered into Amendment No. 1 to the IGA, adding right-of-way costs and revising funding.

 

Staff has been coordinating with the City of Glendale to ensure the pathway connects to existing termination point on the west side of New River at Williams Road to the new section of pathway to be constructed on the east side of New River.

 

The New River North Shared Use Pathway project consists of:

 

  • Roughly 2,600 foot long, 10 foot wide, concrete multi-use pathway

 

  • Extend the New River pathway from its current terminus on the west side of New River at Williams Road

 

  • Extend the pathway across New River

 

  • Extend the New River Trail from Hillcrest Blvd to Patrick Lane

 

  • Connect the bike lane on Hillcrest Blvd to the New River Trail

 

  • Remove concrete barriers, construct new entry wall and gate

 

The purpose of this Agreement is to identify and define the responsibilities of the Cities of Glendale and Peoria for the design, rights-of-way acquisition, construction, construction management, and operation and maintenance of the project.  A summary of each agency responsibilities are summarized below:

 

City of Glendale

  • Fully fund seventy percent of the shared project cost, Making Glendale's estimated share $204,071.82;

 

  • Complete necessary right-of-way acquisitions for the portion of the project that is within the jurisdiction of Glendale;

 

  • Upon completion of construction for the project, prepare a final accounting of the final costs for each agency;

 

  • Discuss any change orders that will impact Peoria's proportionate share;

 

  • Invoice Peoria within 30 days of award of a project construction contract for one-half of its share of the shared project cost;

 

  • Invoice Peoria within 30 days of completion of construction of the project, or no later than June 30, 2018 (whichever occurs first), prepare a final accounting including change order costs not previously paid, and invoice Peoria for the remainder of its share of the shared project cost incurred to date; or reimburse Peoria for any previous over-payments;

 

  • Monitor design of the project with ADOT, provide project plans and specifications to Peoria (including interim submittals as appropriate) for review and comment, allow three weeks for review, and incorporate Peoria comments, if any, into the project as appropriate;

 

  • Provide Peoria with final construction documents;

 

  • Operate and maintain the portion of the completed project that is within the jurisdiction of Glendale.  The maintenance activities include, but are not limited to, maintaining the flood control function of the project, including sediment and vegetation removal in culverts and under the bridge and any and all aesthetic, park, and public use features, maintenance of landscaping, irrigation, multi-use trails and berms, removal of trash and debris, electricity and other operation costs for the facilities, vandalism repair and replacement, and structural repair and replacement of flood control structures.

 

City of Peoria

  • Fully fund thirty percent of the Shared Project Cost, making Peoria's estimated share $87,714;

 

  • Complete necessary right-of-way acquisition for the portion of the projects that is within the jurisdiction of Peoria;

 

  • Participate in a final inspection of the completed project with Glendale;

 

  • Pay Glendale within receipt of the invoice for one-half of its share of the Shared Project Cost;

 

  • Within 30 days of completion of construction of the project, or no later than June 30, 2018 (whichever occurs first), prepare a final accounting including change order costs not previously paid, and pay Glendale the remainder of its share of the Shared Project Cost incurred to date;

 

  • Operate and maintain the portion of the completed project that is within the jurisdiction of Peoria.  The maintenance activities include, but are not limited to , maintaining the flood control function of the project, including sediment and vegetation removal in culverts and any and all aesthetic, park, and public use features, maintenance of landscaping, irrigation, multi-use trails and berms, removal of trash and debris, electricity and other operation costs for the facilities, vandalism repair and replacement, and structural repair and replacement of the flood control structures;

 

  • Any local permits required for the project that are issued by the parties shall be issued at no cost to the Project.

 

  • Maintain the property (APN 200-07-714) barrier wall, access gate and landscape and irrigation system located west of the barrier wall that are part of the project.
Previous Actions:

  • Coordination with City of Glendale to connect the trail of the west side of New River with the Trail to be constructed on the east side of New River.

 

  • Budget for the City of Peoria share of the project was programmed.
Options:

A: Approve the adoption of the resolution approving the Agreement for the construction of the New River North Shared Pathway improvements.

 

B: Deny the adoption of the resolution approving the Agreement for the construction of the New River North Shared Pathway improvements.

Staff Recommendation:

Discussion and possible action to adopt RES. 2017-86 approving an Intergovernmental Agreement with the City of Glendale for the New River North Shared Use Pathway Improvements.
Fiscal Analysis:

The following is a summary of the project funding:

 

Federal Funds (Construction):                         $300,850.00

Design and Construction Costs - Peoria:         $  87,459.35

Design and Construction Costs - Glendale      $204,071.82

 

Peoria's share of the local match for the construction of the New River North Shared Use Pathway is estimated at $87,714.  The City will also be responsible  for a share of the costs associated with change orders and cost overruns as determined by final accounting.  Funding for the pathway improvements is available in the capital improvement program in the following account:

Narrative:

  • December 2017 - 404 permit, environmental, utility and right-of-way clearances.
  • December 2017 - Easements/ROW Acquisition.
  • February 2018 - Final Design.
  • March 2018 - ADOT to Advertise Project for Bid.
  • Construction:  Summer-Fall by ADOT's contractor.
