Discussion and possible action to authorize the holding of an Executive Session for the purpose of discussions or consultations with designated representatives of the public body and/or legal counsel in order to consider its position and instruct its representatives regarding:

(a)Advice, discussion, and instruction with legal counsel and staff regarding proposed ground lease with KLOS Enterprises, LLC regarding the Arizona Broadway Theater located at 7701 West Paradise Lane pursuant to A.R.S. §§38- 431.03.A.3 and 38-431.03.A.4.
(b)Advice, discussion, and instruction with legal counsel and staff regarding proposed ground lease agreement regarding the Peoria 101 Project, located at Peoria Avenue and Loop 101, pursuant to A.R.S. §§38- 431.03.A.3 and 38-431.03.A.4.

The above-named Public Body of the City of Peoria, Arizona will convene into Executive Session pursuant to A.R.S. 38-431.03 for those items listed on the agenda. Only those persons who are:

  • Members of the Public Body, or
  • Officers of the City that are required to attend, or 
  • Those individuals whose presence is reasonably necessary for the Public Body to carry out its Executive Session responsibilities as determined by the City Attorney may be present during the Executive Session.

All persons who remain present during the Executive Session are reminded that the business conducted in Executive Session, including all discussion taking place herein, is confidential and may not be disclosed to any person, except as permitted by law.

Arizona Open Meeting Act:

Arizona law requires that persons who are present in an executive session receive instruction regarding the confidentiality requirements of the Arizona Open Meetings Act. Minutes and discussions made during executive sessions are confidential and may not be disclosed to any party, except:

  • Members of the Council, 
  • Appointees or employees who were subject of discussion under the personnel item
    subsection of the Open Meetings Act, 
  • County Attorney or Attorney General pursuant to an investigation of a violation of the Open Meetings Act, and
  • Arizona Auditor General in connection with an audit authorized by law.

Any person who violates or who knowingly aids, agrees to aid, or attempts to aid another person in violating the Arizona Open Meetings Law may be punished by fine of up to $500.00 per violation and/or by removal from public office.

7C.Board and Commission Appointments

Discussion and possible action to approve the recommendations from the Council Boards and Commissions Subcommittee pertaining to the following appointments and reappointments, and adopt Resolutions as presented: 

 

  • Adopt  RES. 2017-37 reappointing Lizabeth Gordon and Suzanne Roy as regular members to the Arts Commission for terms to expire in June 2021; and

  • Adopt RES. 2017-38 reappointing Neil Terry as a regular member to the Economic Development Advisory Board for a term to expire June 2021; and

  • Adopt  RES. 2017-39 reappointing Nelson Benton and Leslie Fountain as regular members to the Library Board for terms to expire June 2021; and

  • Adopt RES. 2017-40 reappointing George Johnson as a regular member to the Public Safety Personnel Retirement System Local Fire Board for a term to expire June 2021; and

8C.Initial Zoning, New River, Rose Garden Lane and Rose Avenue Alignments

Discussion and possible action to adopt ORD. 2017-17, approving a change in zoning for approximately 2.1 acres, generally located west of the southwest corner of the New River and Rose Garden Lane and Ross Avenue alignments from the Glendale A-1 and Single Family R1-6 Districts to the City of Peoria General Agricultural (AG) and Single Family Residential R1-6 Zoning Districts.

9C.Initial Zoning, 83rd Avenue and Pinnacle Peak Road

Discussion and possible action to adopt ORD. 2017-18, approving a change in zoning for approximately 7.22 acres located at the northwest corner of 83rd Avenue and Pinnacle Peak Road from Maricopa County Rural 43 (RU-43) to City of Peoria Suburban Ranch 43 (SR-43).

 

10C.Amendment 2, Intergovernmental Agreement, Maricopa County Trail Alignment
Discussion and possible action to approve the Second Amendment to the Intergovernmental Agreement (IGA) with Maricopa County for the Maricopa Trail Alignment.
11C.Budget Amendment, Percent for the Arts
Discussion and possible action to approve the budget transfer in the amount of $25,000 from the Percent for the Arts Contingency account to the Percent of the Arts, Grounds Detention Repair and Maintenance account for the repair and final installation of the art piece “Sunset Flight” located at Camino a Lago Park.

 

 

12C.Authorization of Minor Project Scope Change, Peoria Sports Complex Asphalt Remediation, Peoria Sports Complex Improvements Phase 3, 83rd Avenue and Stadium Way

Discussion and possible action to authorize a minor change in project scope that provides for a short term asphalt maintenance solution at the clubhouse parking lots and permits the replacement of narrow asphalt walkways to the practice fields with new, wider, concrete walkways that benefit large public events for the Sports Complex Asphalt Remediation project (CS00179). No change in funding appropriation is required for the current projects.

13C.Final Plat, Elevation Plaza del Rio, Thunderbird Road and Plaza del Rio Boulevard

Discussion and possible action to approve the Final Plat of Elevation Plaza del Rio, located at Thunderbird Road and Plaza del Rio Boulevard, subject to stipulations.

PUBLIC HEARING: A request to consider an appeal of the Planning and Zoning Commission’s decision on March 16, 2017 to approve a Conditional Use Permit for a proposed QuikTrip to be located at the southwest corner of 95th Avenue and Olive Avenue.

Discussion and possible action to adopt a final redistricting map to be effective with the City Council election in 2018 and direct staff to take such actions necessary to implement the selected map.
