Discussion and possible action to concur with the Planning and Zoning Commission's unanimous recommendation to adopt ORD. 2018-05 approving initial zoning for approximately 2.19 acres of recently annexed property located at the northwest corner of 75th Avenue and Banff Lane, from Maricopa County Rural Residential (RU-43) to Peoria Suburban Ranch (SR-43).

The property, located at 14802 N. 75th Avenue, comprises 2.19 acres and is the home of the Life in Christ Lutheran Church. In 2017, the church petitioned to be annexed into the City of Peoria. On September 25, 2017, the Mayor and City Council adopted Ordinance 2017-41, thereby annexing the property into the City.
Pursuant to A.R.S. §9-462.04E, the City must assign 'initial zoning' to the newly annexed land within six (6) months of the effective date of annexation. Additionally, the corresponding zoning cannot permit densities or uses more intense than that provided under the County zoning. In essence, the City attempts to identify the equivalent or most analogous Peoria zoning district to that granted in the County. Accordingly, this is a city-initiated rezoning request to affix initial zoning of Peoria Suburban Ranch (SR-43) to the property.

- On January 18, 2018, the Planning and Zoning Commission held a public hearing on this case. The Commission voted 6-0, recommending approval of this request. There were no speakers in support of opposition to the proposal.

B: Approve the request with modifications; or
C: Deny the request; or
D: Continue action to a date certain; or
E: Remand to the Planning & Zoning Commission for further consideration.

APPROVE as recommended by Staff and the Planning & Zoning Commission.
Pursuant to A.R.S. 9-462.04(E), the municipality must establish initial or equivalent zoning on newly-annexed land within six (6) months of the effective date. To this end, the City is requesting to assign Peoria Suburban Ranch (SR-43) zoning on a privately-owned parcel comprising 2.19 acres, located at the northwest corner of 75th Avenue and Banff Lane. This zoning aligns with the County Rural-43 (RU-43) zoning.
