PUBLIC HEARING - Rezoning, 99th Avenue and Hedge Hog Place 

Purpose:

Discussion and possible action to concur with the Planning and Zoning Commission's unanimous recommendation to adopt ORD. 2018-07 approving the rezoning of approximately 2.25 acres at the northeast corner of 99th Avenue and Hedge Hog Place, from General Agricultural (AG) to Single-Family Residential (R1-10)

Summary:

The applicant, Iplan Consulting Corporation (on behalf of Jarvis Capital Investments, LLC) is requesting to rezone an infill parcel of approximately 2.25 acres, from General Agricultural (AG) to Single-Family Residential (R1-10). The site is located north of Jomax Road near the northeast corner of 99th Avenue and Hedge Hog Place. The property is surrounded by the Pleasant Valley community on three sides. Tierra del Rio is located to the west across 99th Avenue.

 

If approved, the applicant is seeking to subdivide the 2.25 acre property into a six-lot single-family residential development with an overall gross density of 2.67 dwelling units per acre. While the R1-10 district would require a minimum lot size of 10,000 square feet, lots in the proposed development would actually range from 10,275 SF - 10,730 SF. 

 

This infill development was found to be in conformance with the General Plan land use designation of Low Density Residential which has a corresponding range of 2-5 units per acre with a target of 3.0 du/ac. Moreover, the development will be compatible with area conditions; of the twelve lots that surround the property, eight range between 10,500 SF - 12,100 SF. The four lots to the north are slightly larger and range between 13,000 SF - 16,300 SF. 

 

Neighborhood Meeting:

A neighborhood meeting was held on December 6, 2017 at Cross of Glory Lutheran Church (7pm). While the meeting notice was sent to 111 property owners within the area, there were five (5) attendees from the general public. The applicant, staff and the Mesquite Councilmember were also in attendance.  Questions from the public were more inquiry in nature about the development.

 

Deer Valley Unified School District (DVUSD): The site is located within the DVUSD boundary. As part of the rezone process, DVUSD was afforded an opportunity to participate in the review and have dialog with the applicant about the development. DVUSD has indicated that they have no objections to the proposal and that the District and the applicant have agreed to a separate voluntary development assistance agreement.

 

Previous Actions/Background:

  • On January 18, 2018, the Planning & Zoning Commission held a public hearing on this case. The Commission voted 6-0, recommending approval of this request. There were no speakers in support of opposition to the proposal.

 

The City has not received any correspondence in opposition or support to the proposal. On January, 2018, the Planning and Zoning Commission voted unanimously to recommend approval of this request. There were no speakers present from the general public.

Options:

A:  Approve as recommended by Staff and the Planning & Zoning Commission; or

B:  Approve the request with modifications; or

C:  Deny the request; or

D:  Continue the request to a date certain or indefinitely; or

E:  Remand to the Planning & Zoning Commission for further consideration.

 

 

Staff Recommendation:

APPROVE as recommended by Staff and the Planning & Zoning Commission.

 

This infill development was found to be in conformance with the General Plan land use designation of Low Density Residential (2-5 du/ac) and will be compatible with area conditions. Therefore, staff and the Planning & Zoning Commission support rezoning the property from General Agricultural (AG) to Single-Family Residential (R1-10).

Fiscal Analysis:

There is no immediate fiscal impact associated with this case. Should the development move forward, the City would provide infrastructure and operational support.
