Discussion and possible action to adopt RES. 2021-51 declaring an emergency to abandon City interest in a portion of a Federal Patent Easement located at 9412 West Briles Road.

| | | | | | | | Summary:
This request comes from Richard Kuniski who owns the parcel at 9412 W Briles Road. The parcel is identified as Assessor Parcel Number 201-06-026F and is currently encumbered by a 33-foot wide Easement for roadway and utilities along the eastern boundary. The property owner has requested the abandonment of the eastern portion of the Easement within his parcel to allow greater development potential.

Staff reviewed this request and has determined that the Easement that runs along the eastern boundary of the parcel is no longer necessary for roadway and utility purposes. Letters from the existing utility companies giving their consent to the abandonment have also been received by staff. |

Staff recommends City Council approve the adoption of the attached Resolution authorizing the abandonment of City interest in a portion of a Federal Patent Easement for Roadway and Public Utilities as recorded in Docket 2984 Page 101 located at 9412 W Briles Road.
