Land Right Acquisitions, Stadium Trail Phase 1, Skunk Creek from 73rd Ave to 83rd Ave 

Purpose:

Discussion and possible action to adopt RES. 2022-39 authorizing the acquisition of property rights to accommodate trail improvements for the Stadium Trail Multi-Use Path Phase 1 along the north side of Skunk Creek between 73rd Avenue and 83rd Avenue by donation, outright purchase or the exercise of the power of eminent domain.

Summary:

The Stadium Trail Multi-Use Path Phase 1 is currently being designed as 1.75 miles of multi-use pathway situated primarily along the north bank of Skunk Creek between 73rd Avenue and 83rd Avenue. Completion of this segment of multi-use path will close critical gaps within the regional path network.

 

The new trail will connect to the existing trail networks and to the existing bike and pedestrian network along 83rd Avenue. The project includes an alignment for a concrete path with unpaved shoulders. The path resides primarily within land currently owned by the City of Peoria and the Flood Control District of Maricopa County. The project will include working with adjacent businesses, apartment complexes, and the Flood Control District.

 

The City is ready to begin the acquisition of easements from two private property owners to construct the multi-use trail. The easements being acquired will not impact structures or amenities on either of the properties.

Previous Actions/Background:

  • June 2016 - Applied for MAG Design Assistance Funding
  • July 2017 - Completed the Project Assessment
  • Spring 2018 - Regional Federal Funding for Construction
  • March 2021 – Council approved an IGA for ADOT administration of the design and construction of the multi-use path
Staff Recommendation:

Staff recommends that City Council approve the adoption of the attached Resolution authorizing the acquisition of the land rights necessary to construct the trail improvements for the Stadium Trail Multi-Use Path Phase 1 along the north side of Skunk Creek between 73rd Avenue and 83rd Avenue by donation, outright purchase or the exercise of the power of eminent domain.

Fiscal Analysis:

Funding for the acquisitions is available in the FY 2022 Capital Improvement Program - CS00146 Stadium Trail Phase 1 project.
