| Abandonment of City Interest, Easements for Water and Drainage, Multiple Locations |

Discussion and possible action to: (a) adopt RES. 2023-96 abandoning the City’s interest in a certain Water Line Easement per the Big Feat Ventures, LLC Subdivision as Recorded in Book 1039 Page 26 located at 17561 North 91st Avenue and (b) adopt RES. 2023-97 abandoning the City’s interest in a certain Drainage Easement within Lot 1 per the Saddlehorn Ranch Plat as recorded in Book 1222 Page 50 located at 9438 West Saddlehorn Road.

During the final plat process, property owners dedicate easements for various uses within the platted parcels. As properties are developed, there are times that field conditions may alter the location of where utilities are installed or design efforts are made to reduce the size of certain easement areas. These circumstances are present in the current requests for abandonment:
- Big Feat Ventures LLC Subdivision – a portion of the waterline installed within Lot 3A falls outside of the platted waterline easement.
- Saddlehorn Ranch Lot 1 – the owner of this custom home lot will be installing underground drainage pipe to capture the water as it enters the property from the northeast corner of the parcel and direct its flow underground rather than having it sheet flow across the entire parcel frontage.
Staff has reviewed the requests and obtained replacement easements from both of these properties via separate instrument. |

09/15/09 – Council approved the Final Plat of Big Feat Ventures LLC Subdivision.
03/17/15 – Council approved the Final Plat of Saddlehorn Ranch. |
| | | | | | | | Staff Recommendation:
Staff recommends that City Council approve the adoption of the attached Resolutions authorizing the abandonment of portions of a water line easement within the property platted as Big Feat Ventures LLC Subdivision and the abandonment of a portion of a drainage easement within property platted as Saddlehorn Ranch. |

There is no fiscal impact to the City associated with releasing these easement areas. |
