Discussion and possible action to adopt RES. VNCFD 2023-05 authorizing the execution of a deed conveying real property to the City of Peoria to complete the transfer of the underlying fee interest under Vistancia North Community Facilities District ownership.

Prior to the commencement of the original construction activities for sewer infrastructure identified in the Vistancia North Community Facilities District (VNCFD) agreement, the developer(s) transferred the land upon which the infrastructure was to be constructed to the VNCFD to allow for funding of the construction through the VNCFD.

Upon completion of the improvements, the City accepts the infrastructure and takes over operation and maintenance with the final step being the transfer of the underlying fee ownership from the VNCFD to the City.  This request is to complete the final step by transferring the underlying fee ownership for the sewer lift station site from the VNCFD to the City.

There has been no previous action by the District Board for this land transfer.

Staff recommends the District Board approve the adoption of the attached Resolution authorizing the execution of a deed conveying real property from the VNCFD to the City of Peoria

There is no fiscal impact to the District associated with the land conveyance.
