PUBLIC HEARING - Liquor Licenses, Various Locations 

Purpose:

Discussion and possible action to recommend approval to the State Liquor Board for: (a) a Location Transfer for an Off-Sale All (Series 09) Liquor License for Circle K Store #9176, located at 6735 West Peoria Avenue, Maria D. Burgess, Applicant, LL#10015098; (b) a New Restaurant (Series 12) Liquor License for Ta’Carbon The Real Mexican Grill, located at 6750 West Peoria Avenue #101, Gilberto Trujillo Gonzalez, Applicant, LL#23-010857.

Summary:

Circle K Store #9176, is an existing gas station. The owners has applied for a Location Transfer for an Off-Sale All (Series 09) Liquor License.  The application agent is Maria D. Burgess.

 

A Series 09 liquor store license is a "quota" license available only through the Liquor License Lottery or through purchase on the open market.  Once issued, this type of liquor license is transferable from person to person and/or location to location within the same county.  It allows for a spirituous liquor store retailer to sell all types of spirituous liquors, only in the original unbroken package, to be taken away from the premises of the retailer and consumed off the premises.

 

Some of the businesses around Circle K Store #9176 are Taco Bell, China Place and Mega Furniture.  There are no staff concerns with Circle K Store #9176.  The public hearing notice was posted for at least 20 days, and no comments were received during the posting period.  The license application was reviewed according to State law and all Departments gave approvals.

 

Ta’Carbon The Real Mexican Grill, is a new restaurant. The new owners have applied for a New Restaurant (Series 12) Liquor License.  The application agent is Gilberto Trujillo Gonzalez.

 

A Series 12 Restaurant license is a non-transferable license that allows for the restaurant to sell and serve all types of spirituous liquor solely for consumption on the premises.  A Restaurant license requires that at least forty percent (40%) of the restaurant’s gross revenue comes from the sale of food.  Failure to meet the 40% food requirement may result in revocation of the license.

 

Some of the businesses around Ta’Carbon The Real Mexican Grill are Harbor Freight Tools, Ono Hawaiian BBQ and Discount Tire.  There are no staff concerns with Ta’Carbon The Real Mexican Grill.  The public hearing notice was posted for at least 20 days, and no comments were received during the posting period.  The license application was reviewed according to State law and all Departments gave approvals.

Previous Actions/Background:

In May 2009, the Mayor and Council recommended approval to the Arizona State Liquor Board for Circle K Store #9176 for a New Wine and Beer (Series 10) Liquor License located at 6735 W. Peoria Avenue.

 

In May 2001, the Mayor and Council recommended approval to the Arizona State Liquor Board for Gallaghers Food and Fun for a New Restaurant (Series 12) Liquor License located at 6750 W. Peoria Avenue #101.

Staff Recommendation:

Pursuant to Arizona Law the City must make a recommendation to the State Liquor Board regarding the approval of applications to sell alcoholic beverages in the City. The Standard for the City’s recommendation is whether the best interest of the community will be served by the issuance of these licenses and whether the public convenience is served. Staff recommends approval of the above licenses.
