| Abandonment of City Interest, Public Water and Sewer Easement, QuikTrip, 67th Avenue and Happy Valley Road |

Discussion and possible action to adopt RES. 2023-124 to abandon City interest to a portion of a Public Water and Sewer Easement located within the QuikTrip at the southwest corner of 67th Avenue and Happy Valley Road. |
| | | | | | | | Summary:
During the design phase, property owners dedicate easements for various uses within their parcel. There are times when the location of the easements conflict with future development. In December 2014, the owners of Final Plat of QuikTrip #436 Lot 1 dedicated a Water and Sewer Easement within a portion of the parcel; QuikTrip is proposing to add a water kiosk to their site which requires the relocation of an existing waterline connection to a location that falls outside of the platted easement. QuikTrip has requested the abandonment of the easement area that is no longer needed and has dedicated a replacement easement for the area that the new waterline connection will be constructed. |

Staff recommends that City Council approve the adoption of the attached Resolution authorizing the abandonment of a portion of a Water and Sewer Easement from Lot 1 of the Final Plat of QuikTrip #436 located at the southwest corner of 67th Avenue and Happy Valley Road. |

There is no fiscal impact to the City associated with the release of a portion of the Water and Sewer Easement.
