Discussion and possible action to adopt RES. 2024-03 to abandon City interest to a portion of a Drainage Easement and Slope and Drainage Easement dedicated as part of the Master Final Plat for Mystic at Lake Pleasant Heights in the vicinity of Westland and El Mirage Roads.

In February 2019, City Council approved the Master Final Plat of Mystic at Lake Pleasant Heights located in the vicinity of Westland and El Mirage Roads.  This master final plat subdivided a larger piece of land into smaller parcels and dedicated numerous roadways and easements. There are times when the location of easements dedicated in an original plat, conflict with future development.  As development moves forward and these conflicts are brought to light, replacement easements are sought by the City prior to the relinquishment of the conflicting easement.

The current ownership of the Cyrene at Mystic Foothills subdivision (Project R220105), a replat of the above referenced master plat, has requested the abandonment of portions of a drainage easement and a slope and drainage easement that were not captured at the time of replat.  Replacement easements were dedicated to and accepted by the City during the replat process.

02/19/19 – Council approved the Master Final Plat for Mystic at Lake Pleasant Heights.

10/12/21 – Council approved the Replat of Parcels E, F & G of the Master Final Plat for Mystic at Lake Pleasant Heights

06/27/23 – Council approved Cyrene at Mystic Foothills a Replat for Parcel A12 of Mystic at Lake Pleasant Parcels E, F & G

Staff recommends that City Council approve the adoption of the attached Resolution authorizing the abandonment of portion of a Drainage Easement and a Slope and Drainage Easement from the Master Final Plat for Mystic at Lake Pleasant Heights in the vicinity of Westland and El Mirage Roads.

There is no fiscal impact to the City associated with the release of a portion of these easements.
