SUBJECT:
Final Plat, Project Nemo, Northwest Corner of 75th Avenue and Butler Drive Alignment (Project No. R230118) 

Purpose:

Discussion and possible action to approve a Final Plat for Project Nemo, located on the northwest corner of 75th Avenue and Butler Drive (alignment), and authorize the Mayor and City Clerk to sign and record the Final Plat with the Maricopa County Recorder’s Office.

Summary:

The purpose of the Final Plat is to plat the existing agricultural parcel for use as a Trader Joe’s factory, an industrial use and to subdivide another parcel (Lot 2).  This development is within the City’s water and sewer service area. 

 

The final plat is necessary to dedicate right-of-way on 75th Avenue, a public water easement for the proposed water system, public utility easement along 75th Avenue and public sidewalk easements where public pedestrian path deviates away from public right-of-way at the commercial driveways.

Previous Actions/Background:

The Site Plan (SP23-22) was reviewed by the City and approved in December 2023. No significant changes were made to the proposed Final Plat.  Additionally, the parcel falls within the Legacy Point Planned Area Development (PAD), Zoning Case Z21-06, Ordinance No.: 2022-03.

Staff Recommendation:

Staff recommends the approval and subsequent recordation of the attached Final Plat subject to the following stipulations:

 

  1. All civil plans must be approved by the City of Peoria (City) prior to recordation of the Final Plat.

 

  1. An approval of design from the Development and Engineering Department for the necessary improvements in accordance with the City Subdivision Regulations, as determined by the City Engineer, must be obtained prior to recording the Final Plat.

 

  1. The developer must provide a financial assurance in the amount agreed upon by the City Engineer and an Agreement to Install for construction of the infrastructure improvements in accordance with the City Subdivision Regulations, prior to recordation of the Final Plat.

 

  1. In the event that the Final Plat is not recorded within 60 days of Council approval, the Final Plat will become void.  The developer may request re-approval from the City, with the understanding that the City has the option of imposing additional requirements or stipulations.
Fiscal Analysis:

No fiscal impact.
