Discussion and possible action to approve a Development Agreement between Mirage Charter LLC (American Leadership Academy), and the City of Peoria for the development of a charter school and design, construction, dedication, and shared use of a Special Use Park and associated park facilities. |
| | | | | | | | Summary:
Mirage Charter LLC (Mirage) will develop and construct the American Leadership Academy Peoria (ALA), an Arizona public charter school, which will be located on a portion of the Vistancia Commercial Core at the southeast corner of El Mirage Road and Westward Skies Drive.
Concurrently with the construction of ALA, Mirage will coordinate with Vistancia Development LLC (Vistancia) to develop and construct a Special Use Park consisting of approximately 13.7 acres of associated park facilities and amenities on the portion of the Project just southeast of the ALA site. Mirage will also contribute nine hundred thousand dollars ($900,000) towards the development of the Park. Upon completion of the Park, it will be dedicated to the City, which will also satisfy Vistancia’s obligation to construct such a park.
Furthermore, subject to a joint use agreement (JUA) the City and Mirage will share use of certain park facilities and certain school facilities. The shared park facilities are: the baseball, softball, and soccer fields planned on the Park and the shared school facilities are the gymnasium and multipurpose room planned for the project. Mirage will also be obligated to grant an easement to the City across a portion of the ALA site on which Developer will construct both a driveway providing access to the Park and a parking lot that can be used for public parking serving the Park during non-school use hours. The Developer shall be solely responsible for ongoing repair, upkeep, maintenance, and similar expenses of the driveway, parking lot, and shared school facilities. Pursuant to the terms of the Development Agreement, the City will waive all development related fees for permitting, inspection and review services, and be responsible for ongoing repair, upkeep, maintenance of the Park once it has been dedicated to the City. |
