SUBJECT:
Easement, Arizona Public Service, Peoria Dining Complex, Paradise Lane east of 83rd Avenue 

Purpose:

Discussion and possible action to adopt RES. 2024-44 authorizing the City Manager to execute an easement to Arizona Public Service for the installation and maintenance of electrical facilities located along the northside of Paradise Lane east of 83rd Avenue associated with the Peoria Dining Complex project.

Summary:

Development of the Peoria Dining Complex (Common Bond Development Group) at the northeast corner of Paradise Lane and Stadium Way has triggered the design and installation of new utility infrastructure.  While APS has existing infrastructure that they will be able to tie into, the current public utility easement adjacent to the Paradise Lane right of way is not wide enough to support the addition of the new underground power lines.  APS has agreed to construct the electrical facilities necessary to provide power to the Peoria Dining Complex subject to Common Bond and the city granting the necessary easements allowing for the installation and maintenance of these facilities.  Common Bond will be dedicating an easement on their site and has requested the City grant the subject utility easement to APS.

Previous Actions/Background:

No previous Council action has taken place for this request.

Staff Recommendation:

Staff recommends that City Council approve the adoption of the attached Resolution authorizing the execution of the APS easement.

Fiscal Analysis:

There is no fiscal impact to the City associated with the granting of this land right.
