Easement Abandonment, Christ's Church of the Valley, 72nd Avenue and Happy Valley Road 

Purpose:

Discussion and possible action to adopt RES. 2024-48 to abandon City interest to a Drainage Easement dedicated as part of the Final Plat for Christ's Church of the Valley/Terrazza Center in the vicinity of 72nd Avenue and Happy Valley Road.

Summary:

In September 2016, City Council approved the Final Plat of CCV/Terrazza Center located in the vicinity of 72nd Avenue and Happy Valley Road.  This final plat subdivided a larger piece of land into smaller parcels and dedicated numerous easements. There are times when the location of easements dedicated in an original plat, conflict with future development.  As development moves forward and these conflicts are brought to light, replacement easements are sought by the City prior to the relinquishment of the conflicting easement.

 

Christ’s Church of the Valley is adding a new building to their campus (Project R240008), the location of this proposed building conflicts with one of the drainage easements that was dedicated via the above referenced Final Plat.  Ownership has requested the abandonment of the conflicting drainage easement. A replacement easement was dedicated to and accepted by the City during the site development process.

Previous Actions/Background:

  • 09/20/16 – Council approved the Final Plat for CCV/Terrazza Center
  • 05/28/24 – Council approved the acceptance of a replacement stormwater drainage easement
Staff Recommendation:

Staff recommends that City Council approve the adoption of the attached Resolution authorizing the abandonment of a Drainage Easement dedicated as part of the Final Plat of CCV/Terrazza Center in the vicinity of 72nd Avenue and Happy Valley Road.

 

Fiscal Analysis:

There is no fiscal impact to the City associated with the release of the drainage easement.
