Discussion and possible action to adopt RES. 2024-49 declaring a City owned parcel, located east of Lake Pleasant Parkway south of Avenida del Sol, as surplus per the Council adopted Disposal of Surplus Land Policy 3-2 and allow staff to dispose of it based on that policy. |
| | | | | | | | Summary:
The City currently owns land located along the east side of Lake Pleasant Parkway south of Avenida del Sol. This land was acquired as a fee parcel by the City in 2004 as part of the Lake Pleasant Parkway Phase 3A project. The City sought to originally acquire an easement from the larger parcel to fulfill the project needs but ultimately negotiated to acquire the fifteen-foot strip of land as fee ownership. The adjacent parcel was recently purchased and the new owner is actively working with the City to develop the land. New ownership recognizes the benefits of acquiring the fifteen-foot strip of land from the City to maximize their development potential and has submitted a request to the City to acquire the fifteen-foot strip with the understanding that the City would retain an easement to allow the current uses (sidewalk, slope, drainage and utilities) to remain within that footprint. |

- 04/02/24 – Council approved Ordinance 2024-03 to rezone approximately 1.9 acres at the Southeast corner of Lake Pleasant Parkway and Avenida del Sol from Suburban Ranch 43 to Convenience Commercial to facilitate the development of the site as a daycare and preschool facility. This rezone included the fifteen-foot strip of City owned land.

Staff recommends that City Council approve the adoption of the attached Resolution declaring the subject parcel as surplus and authorizing the disposal per the approved council policy. |

There will be minimal title fees associated with the disposal of the property.
