| PUBLIC HEARING - Annexation, 70th Avenue and Pinnacle Peak |

| | | | | | | | Purpose:
Hold a Public Hearing on the proposed annexation of approximately 0.15 acres of privately-owned land generally located east of the northeast corner of 70th Avenue and Pinnacle Peak Road. Pursuant to A.R.S. §9-471, an initial public hearing must be held on the annexation request. Additionally, while public testimony may be taken, the City Council may not take action at this time.

| | | | | | | | Summary:
The City of Peoria is initiating a request on behalf of the Hill Family, for annexation of approximately 0.15 acres, located east of the northeast corner of 70th Avenue and Pinnacle Peak Road. The subject site, owned by the Hill Family, is a 40’ wide strip of land within unincorporated Maricopa County that is located between the Pinnacle Peak Road right-of-way, and the Hill residence.
Their existing residence is located on a lot within the City of Peoria consisting of approximately 1.13 acres and is currently zoned Suburban Ranch (SR-43). The proposed annexation will unite the entirety of the Hill property ownership within the City of Peoria. If annexed, the City will confer Initial Zoning or equivalent zoning that is consistent with or no more intense than the current County zoning within six (6) months of the effective date of annexation.
Annexation Information
The subject property is more specifically depicted in the legal description (Exhibit 1) and map (Exhibit 2). The property is contiguous to the City’s jurisdictional boundaries, lies within the City’s Planning Area (General Plan), and is in conformance with the adopted annexation policy.
The annexation process pursuant to A.R.S. §9-471 is briefly described below:
- Filing of blank petition with County Recorder by the City opens up a thirty (30) day waiting period to discuss the proposal – COMPLETED
- The City must then hold a public hearing (no action) to discuss the proposal within the waiting period – CITY COUNCIL (August 27, 2024)
- At the conclusion of the 30-day waiting period, the municipality has up to 1-year to collect signatures satisfying the annexation “test.” – NOT COMPLETED
- The City to consider and take final action on the annexation request – ANTICIPATED TO BE OCTOBER 1, 2024.
- The annexation is effective 30 days upon adoption of the ordinance.
Under state statute, a successful annexation requires the completion of a petition with (a) signatures of owners of one-half or more in value of the real and personal property; and (b) more than one-half of the persons owning real and personal property that would be subject to taxation by the City in the event of annexation. |

Should the City Council elect to annex the property, the City would assume operational costs associated with the provision and maintenance of services for public safety, water, wastewater, transportation, recreation and general governance, and would be the beneficiary of new property tax revenues. The parcel is located in the City’s water service area. |
