Intergovernmental Agreement, Flood Control District of Maricopa County, Pinnacle Peak and 67th Avenue Drainage Improvements 

Purpose:

Discussion and possible action to approve an Intergovernmental Agreement between the City of Peoria and the Flood Control District of Maricopa for the Construction, Construction Management, Operation and Maintenance of the Pinnacle Peak and 67th Avenue Regional Drainage Improvements. 

Summary:

The Glendale/Peoria Area Drainage Master Plan (ADMP) updated in 2002 calls for drainage and flood control improvements including constructing a channel to intercept flows and convey them to New River within the subject watershed.

 

A Design Concept Report (DCR) was completed in 2007 and due to residential and commercial growth in the area, the DCR was updated in 2021 prior to final design.  

 

The Project area is bounded by Pinnacle Peak Road on the south, Happy Valley Road on the north, 67th Avenue on the east, and New River on the west. This project will construct a regional storm drainage system along Pinnacle Peak Road between New River and 67th Avenue and along 67th Avenue between Pinnacle Peak Road and Hatfield Road. The regional storm drain improvements are anticipated to include storm drains, box culverts, drainage inlets/outlets, structures, channels, and detention/retention basin improvements. The primary goal of the improvements is to provide 100-year flood protection to properties.

 

The design phase of the project is at 90% and moving towards 100%. The land acquisition phase is in progress and the ROW is anticipated to be acquired by February 2025 and the easements will follow. The next phases will be to enter into a construction cost sharing IGA with FCD and executing a construction contract. 

 

The purpose of this IGA is to identify and define the responsibilities of the Flood Control District (FCD) and the City for the project activities related to construction, construction management, operations and maintenance.

 

The FCD will:

  •  Fund 65% of the improvements, estimated at $22,750,000.
  • Participate in public involvement activities.
  • Participate in final inspection of the improvements.
  • Participate with the City in an annual inspection of the improvements.
  • Provide review and comments on post-design or post- construction changes or modifications that may affect the function of the improvements.

 

The City will:

  • Continue to work with the FCD to finalize the design related activities which is currently at 90% completion and to invoice the FCD for it’s share of incurred costs as stated in a previous agreement for design of the Regional Drainage Improvements.
  • The City shall fund 35% of the Regional Drainage Improvements, which is estimated to be at $12,525,000.
  • Obtain FCD review and comments on the design and construction of any future modifications and resolve and incorporate the FCD’s comments into these modifications.
  • Any costs associated with non-flood control features shall be funded solely by the City.
  • Serve as lead agency for the construction activities.
  • Maintain the flood control function of the improvements, which include removing vegetation, trash and debris, vandalism repair and replacement, structural repair and replacement of the flood control structures.
  • Be responsible for all operation and maintenance of the improvements.
  • Schedule and invite the FCD to participate in an annual inspection of the improvements and correct any deficiencies.

 

Previous Actions/Background:

  • In 2007, the City in cooperation with FCD completed a DCR for    67th Avenue between Pinnacle Peak Rd and Happy Valley Rd.

  • On November 10, 2020, City Council approved an IGA with the Flood Control District of Maricopa County for the design, rights-of-way and land acquisition, and utility relocations for the 67th Avenue and Pinnacle Peak Road Regional Drainage Improvements.
Staff Recommendation:

Staff recommends approval of the IGA with the Flood Control District of Maricopa County for Construction, Construction Management, Operation and Maintenance of the Pinnacle Peak & 67th Avenue Regional Drainage Improvements.

Fiscal Analysis:

Per the IGA, the District will contribute up to $22,750,000 toward the construction and construction management for the project.  Funding for this project will be available in the City’s 67th Avenue and Pinnacle Peak Road Regional Drainage Improvements capital project (CIPDR-EN00651) over the span of two fiscal years: $12,185,000 in FY 25 and $11,200,000 in FY26.
