Discussion and possible action to adopt RES. 2024-70 authorizing the City Manager to execute a Right of Way License granting permission for use of city right of way to Christian Brothers Automotive Corporation located in the vicinity of Yearling Road and Lake Pleasant Parkway.

During the review process for an amendment to civil improvements for the Christian Brothers Automotive project, it was discovered that some of the existing and proposed improvements fall within city right of way.  The right of way that the improvements encroach, was originally acquired to address a small wash that impacts the commercial development at the northwest corner of Lake Pleasant Parkway and Happy Valley Road.  The right of way encroachment does not impact the drainage infrastructure or trail improvements within this right of way footprint.  Approval of the civil improvements is contingent upon Christian Brothers entering into a Right of Way License with the City granting the use of the right of way and responsibilities of that use.

Staff recommends City Council approve the adoption of the attached Resolution authorizing the granting of a Right of Way License to Christian Brothers Automotive.
