Land Acquisition for a Drainage Basin, 83rd Avenue/Peoria Avenue/Grand Avenue 

Purpose:

Discussion and possible action to: (a) adopt RES. 2024-84 authorizing the acquisition of property rights for the future drainage improvements located north of Grand Avenue west of 83rd Avenue and south of Peoria Avenue on land currently owned by American Outdoor Advertising LLC. as part of 83rd Avenue/Peoria Avenue/Grand Avenue Drainage Improvement project and (b) approve a budget amendment in the amount of $820,000 from contingency to the 83rd Avenue/Peoria Avenue/Grand Avenue Drainage Improvements project.

Summary:

The 83rd Avenue/Peoria Avenue/Grand Avenue Drainage Improvement project was developed to address recommendations presented in the Peoria Storm Drain Master Plan (PSDMP).  The PSDMP has recommended a combination of storm drain expansion and storm water storage be implemented north of Grand Avenue in order to mitigate peak storm water discharges to the downstream system and increase system capacity. 

 

In June 2023, the City entered into an Intergovernmental Agreement (IGA) with the Flood Control District of Maricopa County (District) for the local cost share of these drainage improvements and to identify/define the responsibilities of the City and District in connection with each phase of the project.  The project is currently in the Design Concept Report phase.  While the City would typically wait for this report to be completed prior to moving forward with the acquisition of land; vacant land suitable for a drainage basin is limited in the project area. 

 

Staff has negotiated a purchase agreement for the subject parcel and an appraisal obtained for the parcel supports the agreed price of $700,000.  The purchase is subject to City Council approval and Phase 1 Environmental Site Assessment.

  • June 2023 - Council approved an IGA with the Flood Control District of Maricopa County
Staff Recommendation:

Staff recommends approval of the adoption of the Resolution authorizing the acquisition of the land rights located at 83rd Ave/Peoria Ave/Grand Ave, and a budget amendment in the amount of $820,000.00 from the city’s contingency appropriation to the 83rd Ave/Peoria Ave/Grand Ave Drainage Improvements project.

Fiscal Analysis:

The FY2025-FY2034 CIP includes the 83rd Ave/Peoria Ave/Grand Ave Drainage Improvements Project (EN00740).  This is a request to advance $820,000.00 of funding from FY2030 to FY2025 to cover the acquisition of the land and ancillary services associated with the purchase.  As such, a budget amendment in the amount of $820,000.00 is required from contingency to the 83rd Ave/Peoria Ave/Grand Ave Drainage Improvements CIP project budget.  In accordance with the IGA with the District, 65% of the acquisition costs are to be reimbursed to the City by the District following acquisition.
