Discussion and possible action to:  (a) adopt RES. 2024-82 Easement per the Final Plat for Parke West Lot 3 as Recorded in Book 927 Page 29 located at 9550 West Northern Avenue and (b) adopt RES. 2024-83 Easement within Lot 6 per the Final Plat for Marketplace at Vistancia as recorded in Book 1776 Page 4 located at 11627 West Lone Mountain Parkway.

During the final plat process, property owners dedicate easements for various uses within the platted parcels.  As properties are developed, there are times that field conditions may alter the location of where utilities are installed or design efforts are made to reduce the size of certain easement areas.  These circumstances are present in the current requests for abandonment:

• Parke West – a portion of the waterline easement platted within Lot 3 in the original Final Plat was relocated and dedicated in the Re-Plat for Lot 3.  This request is to abandon the portion of the easement that is no longer needed.

• Marketplace at Vistancia – the owner of Lot 6 requested the abandonment of the drainage easement that was platted per the Final Plat of Marketplace at Vistancia to allow for the construction of site improvements typically not allowed within a drainage easement.  The property/center owner is responsible for the maintenance of the on-site drainage system, the easement would have allowed for the City to maintain the system if determined that the owner’s lack of maintenance and operation constitutes a nuisance or impacts the public health and safety.

03/06/07 – Council approved the Final Plat of Parke West and on June 7, 2022 – Council approved the Re-Plat for Lot 3 – Parke West.

10/10/23 – Council approved the Final Plat of Marketplace at Vistancia.

Staff recommends that City Council approve the adoption of the attached Resolutions authorizing the abandonment of portions of a water line easement within the property platted as Final Plat of Parke West and the abandonment of a portion of a drainage easement within property platted as Final Plat of Marketplace at Vistancia.

There is no fiscal impact to the City associated with releasing these easement areas.
