| Abandonment of City Interest, Easements for Water and Slope/Drainage, Multiple Locations |

Discussion and possible action to: (a) adopt RES. 2025-25 abandoning the City’s interest in a portion of a certain Water Line Easement Empire Business Park Unit 1- Lot A-5 located at 9025 West Larkspur Drive, (b) adopt RES. 2025-26 abandoning the City’s interest in a portion of a certain Slope and Drainage Easement within Lots 22 – 24 of the Final Plat for Saddleback Village B Parcel 14 Phase 1 (R240039) located near the southeast corner of Saddleback Mountain Way and 135th Lane and (c) adopt RES. 2025-27 abandoning the City’s interest in a portion of a certain Slope and Drainage Easement within Lots 5 – 11, 22 – 24, and 35, Tracts A and C, and a portion of Eagle Claw Drive right of way of the Final Plat for Saddleback Village B Parcel 14 Phase 6 (R240055) located near the northeast corner of Saddleback Mountain Way and Galvin Street.

During the final plat process, property owners dedicate easements for various uses within the platted parcels. As properties are developed, there are times that field conditions may alter the location of where utilities are installed or design efforts are made to reduce the size of certain easement areas. These circumstances are present in the current requests for abandonment:
- Empire Business Park Unit 1 – a waterline easement was dedicated per Maricopa County Recorded Document Number 2022-0819016 within Lot A-5. A request was made by the current property owner to abandon the portion that is no longer needed.
- Saddleback Village B Parcel 14 Phase 1 – a portion of the Slope and Drainage Easement that was dedicated via the Master Plat and more specifically encumbering Lots 22, 23 and 24 of the Saddleback Village B Parcel 14 Phase 1 Final Plat, have been requested to be abandoned as the slope and drainage easements are no longer needed within these identified areas.
- Saddleback Village B Parcel 14 Phase 6 – a portion of the Slope and Drainage Easement that was dedicated via the Master Plat and more specifically encumbering Lots 5 – 11, 22 – 24, and 35, Tracts A and C and a portion of the Eagle Claw Drive right of way of the Final Plat for Saddleback Village B Parcel 14 Phase 6, have been requested to be abandoned as the slope and drainage easement is no longer needed within these identified areas.

01/24/23 – Council approved a Resolution accepting the waterline dedication within Lot A-5 of Empire Business Park Unit 1.
10/15/24 – Council approved the Master Final Plat for Saddleback Village B Parcel 14, Final Plat of Saddleback Village B Parcel 14 Phase 1 and Final Plat for Saddleback Village B Parcel 14 Phase 6. |

Staff recommends that City Council approve the adoption of the attached Resolutions authorizing the abandonment of portions of a water line easement within Empire Business Park Unit 1- Lot A-5 and portions of a slope and drainage easement within Lots 22 – 24 of the Final Plat for Saddleback Village B Parcel 14 Phase 1 and Lots 5 – 11, 22 – 24, and 35, Tracts A and C, and a portion of Eagle Claw Drive right of way of the Final Plat for Saddleback Village B Parcel 14 Phase 6. |
