Discussion and possible action to approve an Intergovernmental Agreement with State of Arizona, City of Glendale, and Maricopa County Department of Transportation for the coordination of the abandonment and conveyance of right-of-way and roadway maintenance responsibilities of certain areas of abandonment along Northern Avenue. |
| | | | | | | | Summary:
The City of Peoria has jurisdiction over Northern Avenue from 71st Avenue to 115th Avenue. As part of the Northern Avenue widening project, there are certain segments of rights-of-way that will be vacated by the Arizona Department of Transportation (ADOT). As such, ownership of rights-of-way, jurisdiction, and maintenance responsibilities will need to be transferred.
Under the terms of the Intergovernmental Agreement (IGA), the State will coordinate the abandonment and conveyance of right-of-way and future roadway and roadside maintenance responsibilities amongst the City of Peoria, City of Glendale, and Maricopa County in the manner depicted in the IGA.
After final acceptance of the project, the State of Arizona will abandon and transfer rights-of-way ownership, jurisdiction, and maintenance responsibilities of the areas as depicted in Exhibits A and B of the Intergovernmental Agreement (IGA) to the City of Peoria, City of Glendale, and Maricopa County in the manner depicted in the IGA.
The purpose of the IGA is to identify and define the responsibilities of each agency. Some of the terms of the IGA are as follows:
The State will:
- Prepare the area of calculations, exhibits, and documentation to receive and accept the right-of-way from Peoria, Glendale, and the County.
- After execution of the Agreement, final acceptance of the project and approval by the State Transportation Board, the State will abandon and transfer right-of-way ownership, jurisdiction, and maintenance responsibilities.
The City of Peoria will:
- After final acceptance and approval of the project, accept ownership, jurisdiction, and maintenance responsibilities of the areas depicted in Exhibits A and B as therein depicted as owned, maintained, and under the jurisdiction of Peoria.
- Assume maintenance responsibility of the right-of-way abandoned to Glendale and the County as shown in Exhibits A and B as therein depicted as maintained by Peoria.
- Maintain all roadway improvements belonging to ADOT, Glendale, and the County along Northern Avenue as depicted in Exhibits A and B.
- Prior to final acceptance of the project, provide documented proof of Peoria’s fee ownership of the real property underlying the right-of-way to be taken in by ADOT, as shown in Exhibit B, including proof that title to said real property is free and clear of all liens and encumbrances.
The City of Glendale will:
- After final acceptance and approval of the project, accept ownership, jurisdiction, and maintenance responsibilities of the areas depicted in Exhibits A and B
- Allow Peoria to assume maintenance responsibility of the right-of-way abandoned to Glendale as shown in Exhibits A and B.
- Maintain all amenities south of the curb along Northern Avenue as depicted in Exhibit A.
- Prior to final acceptance of the project, provide documented proof of Glendale’s fee ownership of the property underlying the right of way to be taken in by ADOT, as shown in Exhibit A, including proof that title to said real property is free and clear of all liens and encumbrances.
Maricopa County will:
- After final acceptance and approval of the project, accept ownership, jurisdiction, and maintenance responsibilities of the areas depicted in Exhibit B as therein depicted as owned, maintained, and under the jurisdiction of the County.
- Prior to final acceptance of the project, provide documented proof of the County’s fee ownership of the property underlying the right of way to be taken in by ADOT, as shown in Exhibit A, including proof that title to said real property is free and clear of all liens and encumbrances.
- Allow Peoria to assume maintenance responsibility of the right-of-way abandoned to the County as shown in Exhibits A and B.

- August 11, 2008 - City Council approved an IGA for Peoria’s participation with the Northern Avenue; Grand Avenue to L303 widening project.
- January 28, 2014 - Provided update to City Council on the status of the Northern Avenue project.
- March 5, 2024 - Provided an overview to City Council on the Northern Avenue fiscally constrained alternative.
- August 20, 2024 - City Council approved an IGA for the rescinding and reimbursement of improvements at 129th Avenue and El Mirage Road which allowed MAG to reallocate federal funding to the Northern Parkway project in accordance with the Arterial Life Cycle Program (ALCP).
