Discussion and possible action to approve an Intergovernmental Agreement with the State of Arizona for maintenance responsibilities associated with the design and construction of improvements on Northern Avenue from 103rd Avenue to 91st Avenue.

Design and construction improvements will be completed on Northern Avenue from 103rd Avenue to 91st Avenue.  Improvements include the installation of new traffic signals at the Northern Parkway intersections by Maricopa County Department of Transportation (MCDOT). In order to complete this work, MCDOT will need to obtain a permit from the State and the City will be responsible for operations and maintenance. The City of Peoria has jurisdiction over Northern Avenue from 71st Avenue to 115th Avenue.

It is to the mutual benefit of the State and the City to enter into an Intergovernmental Agreement (IGA) to specify maintenance responsibilities associated with the design and construction of improvements on Northern Avenue from 103rd Avenue to 91st Avenue. Maintenance responsibilities are defined in the IGA Scope of Work section and shown in Exhibit A.  Some of the terms of the IGA are as follows:

The State will:

• Issue to the City no cost permits on an annual basis for routine maintenance and emergency work. 
• Assist in the coordination of inspection and notify the City when the project is complete and the City’s responsibilities are in effect.
• Not be obligated to maintain the project.

The City will:

• Submit an encroachment permit application, with all required documentation, for a no cost annual maintenance permit for the routine maintenance and emergency work. 
• Maintain the crossroads, as shown in Exhibit A.
• Perform routine/minor maintenance and any structural and non-structural repairs of improvements constructed by MCDOT.
• Provide landscape maintenance and furnish all electrical power and water to operate the irrigation system.
• Be responsible for the maintenance and electrical power for the traffic signals on Northern Avenue at 99^th Avenue, 98^th Avenue, Loop 101, 93^rd Avenue, and 91^st Avenue.
• Be responsible for the maintenance and electrical power for the roadway and underdeck lighting along Northern Avenue from 91^st Avenue to 103^rd Avenue.

• August 11, 2008 - City Council approved an IGA for Peoria’s participation with the Northern Avenue; Grand Avenue to L303 widening project.
• January 28, 2014 - Provided update to City Council on the status of the Northern Avenue project.
• March 5, 2024 - Provided an overview to City Council on the Northern Avenue fiscally constrained alternative.
• August 20, 2024 - City Council approved an IGA for the rescinding and reimbursement of improvements at 129^th Avenue and El Mirage Road which allowed MAG to reallocate federal funding to the Northern Parkway project in accordance with the Arterial Life Cycle Program (ALCP).

Staff recommends approval the Intergovernmental Agreement with the State of Arizona for maintenance responsibilities associated with the design and construction of improvements on Northern Avenue from 103^rd Avenue to 91^st Avenue.

Funding for the maintenance of Northern Avenue widening improvements is programmed in the City’s 10-year CIP.
