| Abandonment of City Interest, Easements for Drainage and Non-Vehicular Access, Multiple Locations |

Discussion and possible action to: (a) adopt RES. 2025-85 abandoning the City’s interest in a portion of a certain Drainage Easement within Lot 2 of the Trailhead located north of Happy Valley Road east of 83rd Avenue (Deed25-015) and (b) adopt RES. 2025-86 abandoning the City’s interest in a segment of a certain Non-Vehicular Access Easement within Lot 3 of Tuscany Estates (Deed25-014) located north of Pinnacle Peak Road east of 75th Avenue. |
| | | | | | | | Summary:
During the final plat process, property owners dedicate easements for various uses within the platted parcels. As properties are developed, there are times that field conditions may alter the location of where utilities are installed or design efforts are made to reduce the size of certain easement areas. These circumstances are present in the current requests for abandonment:
- Trailhead Lot 2 – a Drainage Easement was dedicated via the Final Plat within Lot 2. A request was made by the current property owner to abandon the drainage easement; they have granted a replacement drainage easement.
- Tuscany Estates Lot 3 – a Non-Vehicular Access Easement (NVAE) was dedicated via the Final Plat. A request has been made to abandon a segment of the NVAE along the southern side of the parcel.

- 07/10/07 – Council approved the Final Plat for Tuscany Estates.
- 10/17/23 – Council approved the Final Plat for The Trailhead.

| | | | | | | | Staff Recommendation:
Staff recommends that City Council approve the adoption of the attached Resolutions authorizing the abandonment of a drainage easement within Trailhead Lot 2 and a segment of the Non-Vehicular Access Easement within Tuscany Estates Lot 3. |

There is no fiscal impact to the City associated with releasing these easement areas.
