Liquor License Application Various Locations 

Purpose:

Discussion and possible action to recommend approval to the State Liquor Board for:

 

(a) a New Restaurant (Series 12) Liquor License for Barro’s Pizza, located at 9800 W. Happy Valley Road, Michael J. Barro, Applicant, LL#25-011065.

 

(b) a New Restaurant (Series 12) Liquor License for Modo Mio Italian Kitchen, located at 9815 W. Happy Valley Road, Edward J. Inglese, Applicant, LL#24-000795.

 

(c) a New Restaurant (Series 12) Liquor License for Biscuits Cafe, located at 24812 N. 67th Avenue, Dylan E. Ligatich, Applicant, LL#25-010813.

Summary:

Barro’s Pizza, is a new restaurant located at 9800 W. Happy Valley Road. The new owners have applied for a New Restaurant (Series 12) Liquor License.  This location was previously Village Inn.  The application agent is Michael J. Barro.

 

A Series 12 Restaurant license is a non-transferable license that allows for the restaurant to sell and serve all types of spirituous liquor solely for consumption on the premises.  A Restaurant license requires that at least forty percent (40%) of the restaurant’s gross revenue comes from the sale of food.  Failure to meet the 40% food requirement may result in revocation of the license.

 

Some of the businesses around Barro’s Pizza are Lowe’s Home Improvement, US Bank and Freddy’s Frozen Custard & Steakburgers.  There are no staff concerns with Barro’s Pizza.  The public hearing notice was posted for at least 20 days, and no comments were received during the posting period.  The license application was reviewed according to State law and all Departments gave approvals.

 

Modo Mio Italian Kitchen, is a new restaurant located at 9815 W. Happy Valley Road.  This location was previously #1 Brothers Pizza. The new owners have applied for a New Restaurant (Series 12) Liquor License.  The application agent is Edward J. Inglese.

 

A Series 12 Restaurant license is a non-transferable license that allows for the restaurant to sell and serve all types of spirituous liquor solely for consumption on the premises.  A Restaurant license requires that at least forty percent (40%) of the restaurant’s gross revenue comes from the sale of food.  Failure to meet the 40% food requirement may result in revocation of the license.

 

Some of the businesses around Modo Mio Italian Kitchen are Mountainside Fitness, CVS Pharmacy and Taco Bell.  There are no staff concerns with Modo Mio Italian Kitchen.  The public hearing notice was posted for at least 20 days, and no comments were received during the posting period.  The license application was reviewed according to State law and all Departments gave approvals.

 

Biscuits Cafe, is an existing restaurant located at 24812 N. 67th Avenue. The new owners have applied for a New Restaurant (Series 12) Liquor License.  The application agent is Dylan E. Ligatich.

Some of the businesses around Biscuits Cafe are Pizza Hut, Autozone Auto Parts and Super Star Car Wash.  There are no staff concerns with Biscuits Cafe.  The public hearing notice was posted for at least 20 days, and no comments were received during the posting period.  The license application was reviewed according to State law and all Departments gave approvals.

Previous Actions/Background:

There has never been a liquor license at 9800 W. Happy Valley Road.

 

In June 2020, the Mayor and Council recommended approval to the Arizona State Liquor Board for #1 Brothers Pizza for a New Restaurant (Series 12) Liquor License located at 9815 W. Happy Valley Road.

 

In May 2021, the Mayor and Council recommended approval to the Arizona State Liquor Board for Biscuit Cafe for a New Restaurant (Series 12) Liquor License located at 24812 N. 67th Avenue.

 

Staff Recommendation:

Pursuant to Arizona Law the City must make a recommendation to the State Liquor Board regarding the approval of applications to sell alcoholic beverages in the City. The standard for the City’s recommendation is whether the best interest of the community will be served by the issuance of these licenses and whether the public convenience is served. Staff recommends approval of the above licenses.
