Discussion and possible action to approve RES. 2025-100 and an Intergovernmental Agreement with the City of Phoenix, Arizona to establish Amkor Technology Arizona within Phoenix, Arizona Foreign Trade Zone #75.

Due to change in address, Amkor Technology seeks to re-establish the Foreign Trade Zone that had been approved previously in order to conform to their new location. This is not a new request.

Section 4.2.6 of the City of Peoria's approved Development Agreement with Amkor Technology Arizona specifically states the following: Upon Company's request, the City will make reasonable efforts to assist and cooperate with Company throughout Company's Foreign Trade Zone ("FTZ") application process. City makes no representations or warranties, express, implied, statutory or otherwise, concerning the impact or quality of any cooperation or assistance provided by City. Company will be the responsible party as to the Phoenix Foreign Trade Zone No. 75, Foreign Trade Zone process, and the entire Foreign Trade Zone program including concurrence letters.

A companion agreement to this RES. 2025-100 and the Development Agreement is the Intergovernmental Agreement between the City of Peoria, Arizona and City of Phoenix, Arizona to establish Amkor Technology Arizona, Inc., within a Foreign Trade Zone.

On February 20, 2024, the City of Peoria approved a Development Agreement with Amkor Technology Arizona for a Semiconductor Packaging and Testing Facility, located in the City of Peoria ("Amkor Facility").

On June 18, 2024, the City of Peoria approved the Intergovernmental Agreement with the City of Phoenix to establish Amkor Technology within a foreign trade zone. The City also approved RES. 2024-62 supporting Amkor Technology's application for Foreign Trade Zone status within the Phoenix, Arizona Foreign Trade Zone No. 75.

On October 15, 2024, the City approved a Joint Development Agreement between Vistancia Development LLC and Amkor Technology Arizona LLC.

On January 28, 2025, the City held an Executive Session pursuant to discussion or consultation for legal advice concerning Amkor Technology Arizona, Inc., pursuant to A.R.S. § 38-431.03(A)(2), A.R.S. § 38-431.03(A)(3), A.R.S. § 38-431.03(A)(4), A.R.S. § 38- 431.03(A)(7) 

On August 28, 2025, the following items occurred at the City Council meeting:

• Termination of the Joint Development Agreement between Vistancia, Amkor and the City of Peoria: the City approved adoption of RES. 2025-95 to terminate the 3-party agreement governing construction of improvements in FIVE North.
• The City approved adoption of RES. 2025-93 approving a License Agreement to Amkor Technologies to enter and conduct earlier activities on a 104-acre parcel in Core 2 prior to closing escrow on a land exchange agreement.
• The City approved adoption of RES. 2025-92 authorizing the third amendment of Amkor Technology, City of Peoria Economic Development Agreement.
• The City approved adoption of RES. 2025-91 the exchange of a 104-acre parcel in the newly purchased Core 2 with Amkor Technology for 56-acres (parcel D-15/16) located in FIVE North at Vistancia.
