Discussion and possible action to adopt RES. 2025-109 authorizing the City Manager to execute a Right of Way License granting permission for use of city right of way to KJ Gabbard Trust located on the west side of 67th Avenue north of Camino de Oro.

The 67th Avenue, Pinnacle Peak to Happy Valley Roads Capital Improvement Project required the acquisition of rights of way from several parcels within the project footprint.  During the design process, it was determined that the ultimate lane configuration would not be constructed since the existing improvements south of Pinnacle Peak Road did not support receiving the ultimate lane configuration.  Regional drainage improvements are under construction following utility improvements that were either relocated or upgraded to support the current needs in the vicinity.  Since the ultimate lane configuration will not be constructed at this time, staff is agreeable to allowing the KJ Gabbard Trust parcel to continue using a small piece of right of way for their gate keypad which does not interfere with the City’s current use of right of way along their parcel frontage.

Staff recommends City Council approve the adoption of the attached Resolution authorizing the granting of a Right of Way License to KJ Gabbard Trust.

There is no fiscal impact to the City associated with granting this license.
