Discussion and possible action to approve an amendment to an existing Intergovernmental Agreement with the State of Arizona for the design and construction of intersection improvements, modifying the existing intersection improvements, and installation of a new traffic signal at 107th Avenue and Rose Garden Lane.

In 2019, the City applied and received approval for Highway Safety Improvement Program (HSIP) funding from Maricopa Association of Governments (MAG) in the amount of $632,467 to prepare the design, acquire right-of-way and construct intersection improvements and a new traffic signal at 107th Avenue and Rose Garden Lane. 

In 2022, the City entered into an Intergovernmental Agreement (IGA) with the State of Arizona for the design, land acquisition and construction of the intersection improvements and traffic signal at the intersection of 107th Avenue and Rose Garden Lane.  Per the IGA, the State was to administer the design, right-of-way acquisition, and construction of the project. However, as additional right-of-way was necessary, the City acted as the lead agency for land acquisition and acquired all of the necessary rights-of-way.  In order for the City to seek reimbursement for the right-of-way acquisition costs, an amendment to the IGA is necessary. Amendment No. One to the IGA will allow the City to request and be reimbursed an amount not exceed $20,225 for eligible rights-of-way costs.

Below is a summary of the project schedule:

• 2019 - Applied for and received Highway Safety Improvement Program (HSIP) Funding
• April 2022 - Submitted Letter of Initiation to ADOT and received approval
• August 8, 2022 - Council approved IGA with State of Arizona

Staff recommends approval of Amendment Number One to the Intergovernmental Agreement with the State of Arizona for the design and construction of intersection improvements, modifying the existing intersection improvements, and installation of a new traffic signal at 107th Avenue and Rose Garden Lane.

The City has already incurred the right-of-way acquisition costs and will now be reimbursed an amount not to exceed $20,225.
