Intergovernmental Agreement, City of Phoenix, 67th Ave Improvements from Pinnacle Peak to Happy Valley Rd 

Purpose:

Discussion and possible action to approve an Intergovernmental Agreement between the City of Phoenix and the City of Peoria for the Construction, Permitting, Operation and Maintenance of the 67th Avenue; Pinnacle Peak Road to Happy Valley Road Regional Drainage and Street Improvements. 

Summary:

The 67th Avenue alignment from Pinnacle Peak Road to Happy Valley Road is designated as a major arterial roadway. As the area continues to grow and develop, 67th Avenue is anticipated to become over saturated resulting in potential traffic congestion and safety issues.

 

The purpose of this project is to improve 67th Avenue from Pinnacle Peak Road to Happy Valley Road to a major arterial street with bike lanes. The proposed improvements will include widening 67th Avenue to six lanes, bike lanes, raised median or two-way left-turn lane, curb and gutter, signing and striping, street lighting, sidewalk, landscaping, and drainage improvements. Drainage work will include on-site storm drainage system and completion of the regional drainage improvements to convey storm water to the New River and help mitigate flooding of Peoria residents west of 67th Avenue.

 

Peoria currently owns, maintains and operates the 67th Ave. roadway between Pinnacle Peak Rd. West to the Happy Valley Rd. intersection. Phoenix owns, maintains and operates the existing traffic signal, pavement, sidewalks, ramps, signage, and striping at the intersection of 67th Ave. and Happy Valley Rd and sewer and water transmission mains, and customer service connections located with the 67th Ave. roadway serving businesses and residents within Phoenix. The City of Glendale maintains and operates a large 48-inch diameter transmission water main located within the 67th Ave. roadway.

 

This agreement will outline the responsibilities for the coordination between Peoria and Phoenix for the construction and maintenance responsibilities of regional storm drain and roadway improvements. The improvements will help to mitigate flooding of Peoria residents west of 67th Avenue.

 

Phoenix will:

  • Apply for and obtain from Peoria no-cost permits for all work associated with any ongoing annual maintenance permits required and issue to Peoria no-cost permits for all work associated with this Project including design review fees, planning review fees, administrative fees, construction, inspection, and any ongoing annual maintenance permits required.
  • Grant Peoria drainage easements within Phoenix required for the construction and maintenance of the new regional storm drain system.
  • Continue to maintain all existing and new roadway pavement, signage, traffic signals, and pavement markings at the intersection of 67th Avenue and Happy Valley Road intersection.
  • Continue to maintain all existing and new roadway pavement, signage, pavement markings, sidewalks, and sidewalk pedestrian ramps for intersecting side streets and driveways serving the City of Phoenix and businesses.  This also includes the existing sewer and water system improvements within the 67th Avenue right of way.
  • Own and maintain all existing and new improvements along the east side of 67th Avenue behind the back of curb from Pinnacle Peak Road to Happy Valley Road which includes street lighting, landscaping, fire hydrants, and water meters.

 

Peoria will:

  • Apply for and obtain no-cost permits for all work associated with this Project including design review fees, planning review fees, administrative fees, construction, inspection, and any ongoing annual maintenance permits required.
  • Issue no-cost permits to Phoenix for future maintenance of signal equipment located at 67th Avenue and Happy Valley Road and for Phoenix maintained items along 67th Avenue with the project limits of Happy Valley Road and Pinnacle Peak Road.
  • Continue to maintain all existing and new roadway pavement, signage, and pavement markings within 67th Avenue from Pinnacle Peak Road to Happy Valley Road intersection.
  • Own and maintain the new regional and local storm drain improvements being installed with the project including retention basins, weir structures, drywells, catch basins, manholes, and inlet/outlet structures. This includes the regional storm drain improvements east of 67th Avenue within Phoenix limits.
Previous Actions/Background:

  • In 2004, the City entered into an Intergovernmental Agreement (LCON 10804) with the City of Phoenix and Maricopa County to develop a Design Concept Report for 67th Avenue from Pinnacle Peak Road to Happy Valley Road.
  • In 2007, the City in cooperation with the City of Phoenix and Flood Control District (FCD) completed a DCR for 67th Avenue between Pinnacle Peak Road and Happy Valley Road.
  • In 2021, the City in cooperation with the City of Phoenix and the Flood Control District, completed a DCR Update for 67th Avenue between Pinnacle Peak Road and Happy Valley Road.
  • The City entered into an intergovernmental agreement with FCD dated January 13, 2021 (IGA FCD 2020A013) (the DESIGN IGA) to complete and update a DCR for the roadway, water system, and drainage system improvements and to commence design of the project and land acquisition for the project.
  • The City entered into an intergovernmental agreement with the Arizona Department of Transportation (ADOT) dated November 2, 2021 (IGA 21-0008265-I) for funding of drainage improvements on 67th Avenue.
  • The City entered into an intergovernmental agreement with FCD in 2024 (IGA FCD 2024A003) (the CONSTRUCTION IGA) to complete the construction, for construction management, and for operation and maintenance of the 67th Avenue improvements.
Staff Recommendation:

Staff recommends approval of the IGA with the City of Phoenix for Construction, Permitting, Operation and Maintenance of the 67th Avenue; Pinnacle Peak Road to Happy Valley Road Regional Drainage and Street Improvements.

Fiscal Analysis:

There is no direct fiscal impact with this agreement.
