Executive Session Agenda

2R.An Executive Session pursuant to A.R.S. section 38-431.03(A)(3), 38-431.03(A)(4), 38-431.03(A)(5) and 38-431.03(A)(7) for the purpose of discussions or consultations with designated representatives of the public body and/or legal counsel in order to consider its position and instruct its representatives regarding:
(a)Discussion or consultation for legal advice concerning general Litigation Division and other legal updates, pursuant to A.R.S. § 38-431.03(A)(3) and A.R.S. § 38-431.03(A)(4).

The above-named Public Body of the City of Peoria, Arizona will convene into Executive Session pursuant to A.R.S. 38-431.03 for those items listed on the agenda. Only those persons who are:

  • Members of the Public Body, or
  • Officers of the City that are required to attend, or 
  • Those individuals whose presence is reasonably necessary for the Public Body to carry out its Executive Session responsibilities as determined by the City Attorney may be present during the Executive Session.

All persons who remain present during the Executive Session are reminded that the business conducted in Executive Session, including all discussion taking place herein, is confidential and may not be disclosed to any person, except as permitted by law.


Arizona Open Meeting Act:


Arizona law requires that persons who are present in an executive session receive instruction regarding the confidentiality requirements of the Arizona Open Meetings Act. Minutes and discussions made during executive sessions are confidential and may not be disclosed to any party, except:

  • Members of the Council, 
  • Appointees or employees who were subject of discussion under the personnel item
    subsection of the Open Meetings Act, 
  • County Attorney or Attorney General pursuant to an investigation of a violation of the Open Meetings Act, and
  • Arizona Auditor General in connection with an audit authorized by law.

Any person who violates or who knowingly aids, agrees to aid, or attempts to aid another person in violating the Arizona Open Meetings Law may be punished by fine of up to $500.00 per violation and/or by removal from public office.

3.Mid-Year Financial Review

The study session will examine the state and federal economic conditions in existence. Staff will review with Mayor and Council year-end numbers from Fiscal Year 2025 as well as financial trends for Fiscal Year 2026. Lastly, this study session will forecast some revenue and expenditure parameters for the Fiscal Year 2027 Budget and Capital Improvement Program development.   

4.Peoria Innovation Core Entitlement update

The purpose of this Study Session is to provide the City Council with an update on the progress of the entitlement work for the Peoria Innovation Core, identify next steps and address any questions at this stage of the process.

9C.Position Request and Budget Amendment, Development and Engineering Department

Discussion and possible action to: (a) authorize the addition of a new Building Inspector III full-time equivalent position, and (b) approve related budget amendments in the amount of $160,052.

10C.Budget Amendment, Arts and Culture Department Position Reclassification

Discussion and possible action to authorize a budget amendment of $12,475 to increase salary and benefits for the reclassification of Arts and Culture Coordinator to Arts and Culture Supervisor.

11C.Quarterly Investment Report

Discussion and possible action to receive and file the Quarterly Investment Report for July through September 2025.

 

 

 

 

 

12C.Peoria Public Transportation Agency Safety Plan, Revision 4

Discussion and possible action to approve the Peoria Public Transportation Agency Safety Plan Revision 4 to accommodate changes in the agency’s hierarchy as mandated by federal regulations. Recent changes in Peoria staffing require this routine administrative update brought to the City Council.

13C.Grant, Tohono O’odham Nation, Technology upgrades for the Centennial Plaza Amphitheater

Discussion and possible action to: (a) approve a grant award from the Tohono O’odham Nation to the City of Peoria in the amount of $150,000 to purchase technology upgrades for the Centennial Plaza Amphitheater; and (b) approve a budget amendment in the amount of $150,000 from Contingency to Arts and Culture.

14C.Grant, Maricopa Association of Governments, Fiscal Year 2025 Federal Transit Administration Section 5310 Grant

Discussion and possible action to request City Council approval to accept funding from the Federal Transit Administration Section 5310 Enhanced Mobility of Seniors and Individuals with Disabilities Program in the amount of $166,974, with a required local match of $166,974, to support the City’s ongoing efforts to provide accessible and equitable transportation services for seniors and individuals with disabilities.

15C.Grant, Creative West TourWest, Black History Month

Discussion and possible action: to (a) approve a grant award from Creative West in the amount of $2,750 for Black History Month, and (b) approve a budget amendment for $2,750 from Contingency to Arts and Culture.

16C.Intergovernmental Agreement, Maricopa County, El Mirage Road; SR 303L to Jomax Road

Discussion and possible action to approve an Intergovernmental Agreement with Maricopa County for the design, construction, and construction management, rights of way acquisition, utility relocation, ownership, operation and maintenance of El Mirage Road from SR 303L on the south to Jomax Road on the north.

17C.Intergovernmental Agreement, Maricopa County Sheriff’s Office, Use of Training Facilities

Discussion and possible action to approve an Intergovernmental Agreement between the City of Peoria and Maricopa County Sheriff’s Office. Maricopa County Sheriff’s Office seeks the opportunity for its sworn Deputies to train in defensive tactics at City Facilities.

 

 

 

 

 

 

18C.Intergovernmental Agreement, Arizona Department of Administration Agreement, Senate Bill 1735

Discussion and possible action to enter into an agreement with Arizona Department of Administration to establish and maintain a Law Enforcement Records Management System, which is funded by Senate Bill 1735 and previously approved by Council on August 5, 2025.

19C.Intergovernmental Agreement Amendment, State of Arizona, El Mirage Road; SR 303L to Jomax Road

Discussion and possible action to approve Amendment No. One to the Intergovernmental Agreement with the State of Arizona for the local cost share and preparation of design documents for extending El Mirage Road from SR 303L on the south to Jomax Road on the north.

20C.Right of Way License, Gabbard, North of Northwest Corner 67th Avenue and Camino de Oro

Discussion and possible action to adopt RES. 2025-109 authorizing the City Manager to execute a Right of Way License granting permission for use of city right of way to KJ Gabbard Trust located on the west side of 67th Avenue north of Camino de Oro.

Discussion and possible action to authorize: (a) the procurement and implementation of dispatching software, (b) the replacement of the WeRIDE microtransit service, and (c) the operational changes to reduce reliance on Valley Metro.
22R.Code Amendment, Chapter 21 (Zoning), Middle Housing

Discussion and possible action to concur with the Planning and Zoning Commission’s recommendation and adopt ORD. 2025-29, amending Sections 21-200, 21-400 and 21-900 within the Peoria City Code (Zoning Ordinance).
