2R.An Executive Session pursuant to A.R.S. section 38-431.03(A)(3), 38-431.03(A)(4), 38-431.03(A)(5) and 38-431.03(A)(7) for the purpose of discussions or consultations with designated representatives of the public body and/or legal counsel in order to consider its position and instruct its representatives regarding:

The above-named Public Body of the City of Peoria, Arizona will convene into Executive Session pursuant to A.R.S. 38-431.03 for those items listed on the agenda. Only those persons who are:

  • Members of the Public Body, or
  • Officers of the City that are required to attend, or 
  • Those individuals whose presence is reasonably necessary for the Public Body to carry out its Executive Session responsibilities as determined by the City Attorney may be present during the Executive Session.

All persons who remain present during the Executive Session are reminded that the business conducted in Executive Session, including all discussion taking place herein, is confidential and may not be disclosed to any person, except as permitted by law.


Arizona Open Meeting Act:


Arizona law requires that persons who are present in an executive session receive instruction regarding the confidentiality requirements of the Arizona Open Meetings Act. Minutes and discussions made during executive sessions are confidential and may not be disclosed to any party, except:

  • Members of the Council, 
  • Appointees or employees who were subject of discussion under the personnel item
    subsection of the Open Meetings Act, 
  • County Attorney or Attorney General pursuant to an investigation of a violation of the Open Meetings Act, and
  • Arizona Auditor General in connection with an audit authorized by law.

Any person who violates or who knowingly aids, agrees to aid, or attempts to aid another person in violating the Arizona Open Meetings Law may be punished by fine of up to $500.00 per violation and/or by removal from public office.

5C.Settlement Agreement, William Schwartz v. City Peoria

Discussion and possible action to: (a) approve a settlement in the amount of $100,000 to settle a claim brought by William Schwartz against the City of Peoria; (b) authorize the City Manager to execute all necessary documents to settle the claim; and (c) approve a budget amendment in the amount of $100,000 from Contingency to the Insurance Reserve Fund.  

6C.Water Services Fiscal Year 2026 Capital Improvement Program Budget Re-allocation Request
Discussion and possible action to reallocate existing Fiscal Year 2026 water/wastewater Capital Improvement Program funding to create financial capacity needed to accelerate two wastewater projects.
7C.Code Amendment, Chapter 21 (Zoning), Animal Shelters (TA25-03)

Discussion and possible action to concur with the Planning and Zoning Commission’s recommendation and adopt ORD. 2026-05, amending Sections 21-503 ("Land Use Matrix") and 21-505 ("Limitations on Uses") within the Peoria City Code (Zoning Ordinance), pertaining to the addition of Animal Shelters as a permitted use within the Intermediate Commercial (C-2) zoning district.

8C.Grants, Arizona Department of Homeland Security, Statewide Disaster Response Program

Discussion and possible action to: (a) authorize the acceptance of a grant from the Arizona State Department of Homeland Security totaling $90,595, and (b) approve a budget amendment in the amount of $90,595 from the Contingency Fund to the Arizona State Department of Homeland Security Grants Fund.

 

 

 

 

9C.Resolution, HOME Investment Partnerships Program; Community Housing Development Organization Application Support; Newtown Community Development Corporation

Discussion and possible action to adopt RES. 2026-26 certifying compliance with the City of Peoria’s Consolidated Plan and providing administrative commitment in support of a HOME Investment Partnerships Program Community Housing Development Organization application submitted by Newtown Community Development Corporation for an affordable housing project located within the City of Peoria.

10C.Lease Agreement, 8344 West Washington Street, Apartments #2 and #3

Discussion and possible action to authorize (a) the City to enter into a 90-day short-term lease agreement with the current tenants residing at 8344 West Washington Street, in Apartments #2 and #3 (APN 142-41-017A), and (b) a budget amendment in the amount of $2,220 from Contingency to the Half Cent Sales Tax Fund for short-term utility costs.

11C.Maintenance Improvement District No. 1297, Saddleback Village B Parcel 5 Phase 1, Vistancia Boulevard and Leisure Lane

Discussion and possible action to approve the Petition for Formation, adopt RES. 2026-27 Intention and ordering the formation of proposed Maintenance Improvement District No. 1297, Saddleback Village B Parcel 5 Phase 1; and adopt RES. 2026-28 ordering the improvements within the proposed Maintenance Improvement District and declaring an emergency.

14R.Minor General Plan Amendment, The Shoppes & The Cove at Camino A Lago, Lake Pleasant Parkway & Deer Valley Road (GPA25-06)

Discussion and possible action to concur with the Planning and Zoning Commission's recommendation to adopt RES 2026-33, amending the General Plan Land Use designation for 24.2 acres from Mixed-Use Main-Street (12-20+ dwelling units per acre) to Mixed-Use Neighborhood Village (12-20 dwelling units per acre). The site is located at the northeast corner of Lake Pleasant Parkway and Deer Valley Road.

15R.Rezoning, The Shoppes & The Cove at Camino A Lago, Lake Pleasant Parkway & Deer Valley Road (Z25-12)

Discussion and possible action to concur with the Planning and Zoning Commission's recommendation to adopt ORD. 2026-07, a rezone of approximately 24.2 acres from General Agricultural (AG) to The Shoppes and The Cove at Camino-A-Lago Planned Area Development (PAD) zoning district. The rezoning would facilitate the development of a horizontal mixed-use site consisting of approximately 8 gross acres of commercial as well as a 16-acre 105-lot single-family residential subdivision. The site is located at the northeast corner of Lake Pleasant Parkway and Deer Valley Road.

16R.Code Amendment, Chapter 21 (Zoning), Code Modernization (TA26-01)

Discussion and possible action to concur with the Planning and Zoning Commission's recommendation and adopt ORD. 2026-06, amending various sections of Chapter 21 of the City Code (Zoning), including operational limitations for car washes and service stations, aligning duration of political signs with Arizona Revised State Statutes, and removing duplicative regulations and consolidating uses in the Non-Residential District to align with industry practices and terms.

17R.Development and Disposition Agreement, Newtown Community Development Corporation, Affordable Housing Development

Discussion and possible action to adopt RES. 2026-34 approving a Development and Disposition Agreement between the City of Peoria and Newtown Community Development Corporation for the conveyance of City-owned property located at 8490 West Washington Street for the development of long-term affordable housing; authorizing the City Manager, or designee, to execute the Development and Disposition Agreement and related documents; and authorize the City Manager, or designee, to approve administrative and non-material amendments to the Development and Disposition Agreement, including adjustments to the Schedule of Performance.
