Executive Session Agenda

2.An Executive Session for the purpose of discussions or consultations with designated representatives of the public body and/or legal counsel in order to consider its position and instruct its representatives regarding:
(a)Employment, assignment, appointment, promotion, or salaries of a public officer or appointee pertaining to the performance evaluation of the City Attorney pursuant to A.R.S. § 38-431.03.A.1.

The above-named Public Body of the City of Peoria, Arizona will convene into Executive Session pursuant to A.R.S. 38-431.03 for those items listed on the agenda. Only those persons who are:

  • Members of the Public Body, or
  • Officers of the City that are required to attend, or 
  • Those individuals whose presence is reasonably necessary for the Public Body to carry out its Executive Session responsibilities as determined by the City Attorney may be present during the Executive Session.

All persons who remain present during the Executive Session are reminded that the business conducted in Executive Session, including all discussion taking place herein, is confidential and may not be disclosed to any person, except as permitted by law.


Arizona Open Meeting Act:


Arizona law requires that persons who are present in an executive session receive instruction regarding the confidentiality requirements of the Arizona Open Meetings Act. Minutes and discussions made during executive sessions are confidential and may not be disclosed to any party, except:

  • Members of the Council, 
  • Appointees or employees who were subject of discussion under the personnel item
    subsection of the Open Meetings Act, 
  • County Attorney or Attorney General pursuant to an investigation of a violation of the Open Meetings Act, and
  • Arizona Auditor General in connection with an audit authorized by law.

Any person who violates or who knowingly aids, agrees to aid, or attempts to aid another person in violating the Arizona Open Meetings Law may be punished by fine of up to $500.00 per violation and/or by removal from public office.

Discussion and possible action to adopt ORD. 2019-11 amending Chapter 9 of the Peoria City Code, by amending sections 9-31 and 9-33 pertaining to the International Fire Code.

5C.Code Amendment, Chapter 18, Building and Building Regulations

Discussion and possible action to adopt ORD. 2019-12, amending Chapter 18 of the Peoria City Code, Building and Building Regulations, to include the adoption of the 2018 International Code Council codes and the 2017 edition of the National Electrical Code. 

6C.Code Amendment, Chapters 25 and 27, Utility Rates and Charges

Discussion and possible action to adopt ORD. 2019-13 amending Chapters 25 and 27 of the Peoria City Code to incorporate reference for utility rates and charges.

7C.Grant, Governor’s Office of Highway Safety, DUI/Impaired Driving and Selective Traffic Enforcement Police Vehicle Package

Discussion and possible action to: (a) authorize the acceptance of funding from the Governor’s Office of Highway Safety (GOHS) in the amount of $51,667, to purchase one (1) police vehicle package to enhance DUI/impaired driving and selective traffic enforcement throughout the City of Peoria; and (b) approve a budget amendment in the amount of $51,667 from the Proposed Grants Contingency account to the GOHS Grants account.

8C.Intergovernmental Agreement, Arizona Department of Revenue, Administration of Transaction Privilege Tax

Discussion and possible action to adopt RES. 2019-90 approving the revised Intergovernmental Agreement (IGA) with the Arizona Department of Revenue (ADOR) for the uniform administration, licensing, collection, and auditing of transaction privilege tax, use tax, severance tax, jet fuel excise and use tax and rental occupancy taxes imposed by the State or cities or towns.

9C.Intergovernmental Agreement, Maricopa County, Union Hills Drive Improvements, 111th Avenue to 107th Avenue

Discussion and possible action to adopt RES. 2019-91 authorizing the City Manager to execute an Intergovernmental Agreement (IGA) with Maricopa County to improve Union Hills Drive from 111th Avenue to 107th Avenue.

10C.Intergovernmental Agreement Amendment, City of Glendale and Sun City Fire Department, Fire and Medical Response Reimbursement

Discussion and possible action authorizing the City Manager to execute an Intergovernmental Agreement Amendment with the City of Glendale, and the Sun City Fire and Medical Department for the reimbursement of fire and medical responses by those agencies to the Desert Diamond Casino and Entertainment, an Enterprise of the Tohono O’odham Nation.

11C.PerfectMind Project Budget Transfer

Discussion and possible action to: (a) approve a budget transfer in the amount of $12,636 from the Information and Technology Department (IT) Projects Training account to the Parks, Recreation and Community Facilities (PRCF) Administration Computer Hardware account; (b) approve an ongoing transfer of $106,000 from the IT Operations Hosted Software Solutions account to the PRCF Administration Hosted Software Solutions account and the PRCF Administration Computer Software Supplies and Maintenance account; and (c) authorize the expenditure of savings from the implementation and subscription fees for use in funding future subscription costs, software and hardware needs directly related to opportunities for efficiencies created with the enhanced functionality of the PerfectMind registration and financial system.

12C.Maintenance Improvement District No. 1234, Bella Brisa, 75th Avenue and Running Horse Lane

Discussion and possible action to approve the Petition for Formation, adopt RES. 2019-79 Intention and ordering the formation of proposed Maintenance Improvement District No. 1234, Bella Brisa, located at 75th Avenue and Running Horse Lane; and adopt RES. 2019-80 ordering the improvements within the proposed Maintenance Improvement District and declaring an emergency.

13C.Declare Surplus Land, 107th Avenue and Rose Garden Lane

Discussion and possible action to adopt RES. 2019-92 declaring Tract G of the Rose Garden final plat, located east of 107th Avenue north of Rose Garden Lane, as surplus per the Council adopted Disposal of Surplus Land Policy.
